RESOLUTION NO. 1683
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARROYO GRANDE CONFIRMING THE REPORT OF THE SUPERINTENDENT
OF STREETS AND LEVYING ASSESSMENT FOR THE INSTALLATION
OF CONCRETE CURBS, GUTTERS, SIDEWALKS, DRIVEWAY APRONS
AND DRIVEWAY CONFORMANCE
WHEREAS, pursuant to the provisions of the "Improv~nt Act of 1911",
being Division 7 of the Streets and Highways Code of the State of California,
the Superintendent of Streets did, on the 23rd day of December, 1981, notify
the owners of persons in possession of those certain propertIes within the
City of Arroyo Grande, California, located as follows:
I; South side of Fair Oaks Avenue, Elm to Walnut.
2. West side of Halcyon Road, Grand to Bennett.
3. East side of Halcyon Road, Fair Oaks to Dodson Way.
4. East side of Ha1cyon Road, Fair Oa~s to Todd lane.
5. North side of HuasnaRoad, Oro to Corbett Canyon.
6. North side of Huasna Road, Oro to Stagecoach Road.
7. West side of Garden Street, East Cherry to Allen Street.
8. South side of Fair Oaks Avenue, Beech to Pecan Street.
9. North side of East Cherry Avenue, Garden to Pacific
- Coast Rai Iway.
10. North side of Fair Oaks Avenue, Elm to Walnut Street.
11. North side of Fair Oaks Avenue, Alter to Walnut Street.
12. North side of Fair Oaks, Halcyon to Alder Street.
13. North side of East Cherry, Pacific Coast Railway to Traffic Way.
to cause certain Installation of curbs, gutters, driveway aprons and driveway
conformance to be made adjacent to the hereinabove property; that some owners
or persons in possession, so notified, failed and neg1ected to cause said
InstallatIon to be made; and that the Superintendent of Streets proceed to have
said Instal1atlon done and made at a total cost of Ten Thousand, Nine Hundred
Forty-eight and Fifteen Cents ($10,948.15).
WHEREAS, said Superintendent of Streets, upon the completion of
said installation, filed with this City Council his report upon said installation
and costs thereof, and gave notice to the owners or persons In possession of
said properties hereinabove referred to, in the time, form and manner prescribed
by law, that the hour of 8:00 P.M. on the 11th day of January, 1983, was the
hour fixed for hearing upon said report; and evidence having been received
thereon.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ARROYO GRANDE, AS FOLLOWS:
SECTION I: That all notices have been given as provided by law
and required by the provisions of the "Improvement Act of 1911" and that the
report of the Superintendent of Streets upon the installation be, and It is
hereby confirmed.
SECTION 2: That an assessment in the amount of $9,020. II representing
the installation made by the Superintendent of Streets against the properties
hereinabove described is hereby made and confIrmed; and the Superintendent of
Streets is hereby directed to notify such owners or persons In possession of
said properties of said assessment.

SECTION 3: That if the owners or o~rsons in possession of said
properties fai1 to pay said assessment within ~lve (5) days from the date
hereof. as provided by 1aw, or enter rnto an agreement with the City to pay
said assessment over a period of time not to exceed two years, at an annual
interest rate of ten percent (10%). the Superintendent of Streets shall
record a Notice of Lien in the Office of the County Recorder of the County
of San Luis Obispo.
