RESOLUTION NO. 1661
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ARROYO GRANDE SETTING FORTH ITS INTENTION
TO VACATE AND ABANDON A PORTION OF A SEWER
LINE EASEMENT AND A PORTION OF A WATER LINE
EASEMENT ON OAK PARK BOULEVARD, SOUTH OF
JAMES WAY, IN THE CITY OF ARROYO GRANDE AND
FIXING TIME AND PLACE FOR HEARING AS PROVIDED
BY GOVERNMENT CODE SECTION 50430, ET SEQ.
WHEREAS, the City Council of the City of Arroyo Grande elects
to proceed with the vacation and abandonment of a portion of a sewer line
and a portion of a water line easement on Oak Park Boulevard, south of
James Way, pursuant to Section 50437 of the Government Code of the State
of California; and
WHEREAS, It appears that said portion of sewer line and portion of
I water line Is unnecessary for present or prospective use; and

WHEREAS, it appears that the abandonment Is for the best interests
of the pub II c.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ARROYO GRANDE that It intends to vacate and abandon the hereinafter described
sewer line and water line, In the City of Arroyo Grande, County of San Luis
Obispo, State of California. For this purpose, the City Council will hold a
public hearing in connection with said intention to vacate and abandon
the hereinafter described portion of sewer line and portion of water line,
which hearing will be held In the Council Chambers, 215 East Branch Street,
Arroyo Grande, California, on the 14th day of September, 1982, at the hour
of 8:00 P.M. At said time, those persons Interested in or objecting to the
proposed vacation and abandonment may appear and be heard.
BE IT FURTHER RESOLVED that the City Clerk of the City of Arroyo
Grande be, and Is herewi th dl rected to cause to be posted along said portion
of the sewer line and water line on Oak Park Boulevard at Intervals not to
exceed three hundred feet (300') In distance apart and at least three (3)
In number on said road, notices of passage of Resolution, which said notices
shall be entitled "NOTICE OF INTENTION TO VACATE AND ABANDON A PORTION OF
A SEWER LINE EASEMENT AND A WATER LINE EASEMENT, ON OAK PARK BOULEVARD,
SOUTH OF JAMES WAY, IN THE CITY OF ARROYO GRANDE, COUNTY OF SAN LUIS OBISPO,
STATE OF CALIFORNIA".
In addition thereto, the City Clerk h herewith ordered and directed
to cause a copy of said Resolution to be published at least two successive
weeks prior to the hearing In the Five Cities Tlmes-Press-Recorder, a semi-
weekly newspaper published and circulated In the City of Arroyo Grande,
which publication shall be at least ten (10) days prior to the date of said
hear i ng.
BE IT FURTHER RESOLVED that the portion of sewer line easement,
which the City of Arroyo Grande proposes to vacate and abandon, Is more
particularly described as follows:
That portion of a 10 foot wide sewer line easement lying within
the boundary I ines of Parcel "D" of Parcel Hap No. AG 79-838,
as recorded in Book 31 of Parcel Maps, at Page 47, records of
San Luis Obispo C~unty and more particularly described as follows:

Beginning at the northwesterly corner of said Parcel "0"; thence
south 690 44' 56" east along the northeasterly line of said Parcel
"D", a distance of 5.00 feet to the TRUE POINT OF BEGINNING;
thence leaving said northeasterly line of Parcel "0" along the
centerline of the existing 10 foot wide sewer line easement,
5 feet on each side, the following courses: South 200 15' 04"
west parallel and distant 5.00 southeasterly measured at right
angle from the northwesterly line of said Parcel "0", a distance
of 331. 28 feet; thence south 720 49' 37" east, 57.24 feet; thence
south 320 25' O~' west, 24.50 feet to a point on the southwesterly
line of said Parcel "0", from which the southeasterly corner
thereof bears south 720 49' 37" east, 32.34 feet. Note: the
described above shall be lengthened or shortened In order to
terminate at the northeasterly and southwesterly lines of
said Parcel "D" of Parcel Map No. AG 79-838.
BE IT FURTHER RESOLVED that the portion of water lIne easement,
which the City of Arroyo Grande proposes to vacate and abandon, Is more
particularly described as follows:
That portion of a 10 foot public water line easement lying within
the boundary lines of Parcel "D" of Parcel Map No. AG 79-838,
as recorded In Book 31 of Parcel Maps, at Page 47, Records of
San Luis Obispo County and more particularly described as follows:
Beginning at the southwesterly corner of said Parcel "C"; thence
north 16 38' 01" east along the northwesterly line of said
Parcel "C" and the easterly right-of-way line of Oak Park Boulevard,
a distance of 30.00 feet to the TRUE POINT OF BEGINNING; thence
leaving said northwesterly line of Parcel "C" and the easterly
right-of-way line of Oak Park Boulevard along the centerline of
the existing 10 foot wide water line easement, 5 feet on each side,
the following courses: South 720 49' 37" east, 75.00 feet;
thence north 160 38' 01" east, 365.48 feet to a point on the
northeasterly line of said Parcel "C", from which the northwesterly
corner thereof bears north 730 21 59" west, 75.00 feet. Note:
the sidelines of the existing 10 foot wide water line described
above shall be lengthened or shortened In order to termInate at
the northeasterly and northwesterly I ines of said Parcel "C"
of Parcel Map No. AG 79-838.
Further particulars as to the proposed vacation and abandonment are shown
on the map pertaining thereto on file In the office of the City Clerk of
the City of Arroyo Grande.
On motion of Council Member Vandeveer, seconded by Council Member
Hogan, and on the following roll call vote, to wit:
