CC 2020-08-18_06a Consider November 2020 Election MEMORANDUM TO: CITY COUNCIL FROM: BILL ROBESON, ACTING CITY MANAGER WHITNEY McDONALD, ACTING DEPUTY CITY MANAGER BY: KELLY WETMORE, DIRECTOR OF LEGISLATIVE AND INFORMATION SERVICES/CITY CLERK SUBJECT: CONSIDERATION OF APPOINTMENT OF OFFICERS AND CANCELLATION OF THE NOVEMBER 3, 2020 CONSOLIDATED GENERAL MUNICIPAL ELECTION DATE: AUGUST 18, 2020 SUMMARY OF ACTION: Consider appointment of officers and cancellation of the November 3, 2020 Consolidated General Municipal Election as there are not more candidates than offices to be elected. IMPACT ON FINANCIAL AND PERSONNEL RESOURCES: The estimated cost for the November 2020 General Municipal Election as provided by the County of San Luis Obispo is $28,000. Should the Council take action to cancel the election, it would result in a cost savings to the City of approximately $28,000. RECOMMENDATION: Pursuant to Elections Code 10229, as there were not more candidates than offices to be elected as of the close of the official nomination period on August 7, 2020, it is recommended that the City Council adopt a Resolution providing for the appointment to the offices of the City of Arroyo Grande that were to be elected on Tuesday, November 3, 2020, and cancellation of the Consolidated General Municipal Election. BACKGROUND: Pursuant to Municipal Code Section 1.08.010, the City’s General Municipal Election shall be held on the same day as, and consolidated with, the Statewide General Election. The Statewide General Election is held on the first Tuesday after the first Monday in November of even years. On June 9, 2020, the City Council adopted the appropriate Resolutions calling and giving notice of the General Municipal Election to be held in the City on Tuesday, November 3, 2020, for the election of certain officers and requesting the County Item 6.a. - Page 1 CITY COUNCIL CONSIDERATION OF APPOINTMENT OF OFFICERS AND CANCELLATION OF THE NOVEMBER 3, 2020 CONSOLIDATED GENERAL MUNICIPAL ELECTION AUGUST 18, 2020 PAGE 2 of San Luis Obispo Board of Supervisors consolidate the City’s General Municipal Election with the Statewide General Election. ANALYSIS OF ISSUES: On July 3, 2020, a Notice of Election was published in The Tribune and posted on the City’s website for the offices of Mayor for a 2-year term, and two (2) Members of the City Council for 4-year terms (Attachment 1). In addition, a press release was issued announcing the nomination period for the November election and posted on the City’s website (Attachment 2). The candidate nomination period opened on July 13, 2020, and closed on August 7, 2020. At the close of the nomination period, only one candidate for Mayor and two candidates for City Council Member had been nominated and qualified for the ballot. If no one or only one person is nominated for an elective office, appointment to the elective office may be made as prescribed by Section 10229 of the California Elections Code. The City Clerk is required to submit a certification to the City Council that there are not more candidates than offices to be elected, which was completed and distributed following the close of the Nomination Period (Attachment 3). The certification sets forth the following courses of action that may be taken by the City Council: 1. Appoint to the office the persons who have been nominated; 2. Appoint to the office any eligible voter if no one has been nominated (does not apply); 3. Hold the election if either no one or only person has been nominated. The City Clerk is also required to publish a notice of these facts in a newspaper of general circulation. The notice was published in The Tribune on Wednesday, August 12, 2020. After the 5th day following the date of publication, the Council may, at a regular or special meeting, make the appointments or direct the election be held. The persons appointed shall qualify and take office and serve exactly as if elected at a municipal election for that office. The City Council has followed this appointment process previously by cancelling the general municipal elections in 2008 and 2012 due to the fact that there were not more candidates than officers to be elected. If the City Council acts to appoint the nominees in lieu of holding an election, no City of Arroyo Grande candidates will appear in the voter pamphlet or on the ballot. The cost of printing the ballot and voter information pamphlet and other services rendered to the City by the County of San Luis Obispo to conduct the election varies depending on the number of nominated candidates and other factors. The County Clerk’s estimate for conducting the November election for the City is $28,000. Cancellation of the Consolidated General Municipal Election for the City of Arroyo Grande would save the City these costs and would be consistent with the Elections Code. Item 6.a. - Page 2 CITY COUNCIL CONSIDERATION OF APPOINTMENT OF OFFICERS AND CANCELLATION OF THE NOVEMBER 3, 2020 CONSOLIDATED GENERAL MUNICIPAL ELECTION AUGUST 18, 2020 PAGE 3 ALTERNATIVES: The following alternatives are provided for City Council consideration: 1. Adopt the Resolution to appoint to the office the person who has been nominated for each office and cancel the Consolidated General Municipal Election; or 2. Do not adopt the Resolution and hold the Consolidated General Municipal Election on November 3, 2020. ADVANTAGES: Appointment of the persons nominated to each office would enable the City Council to cancel the election, which would result in a cost savings of approximately $28,000 to the City. DISADVANTAGES: If the Council makes the appointments pursuant to the Elections Code, the City Clerk shall not accept for filing any statement of write-in candidacy submitted after the appointments are made, pursuant to Elections Code Section 10229(c). ENVIRONMENTAL REVIEW: No environmental review is required for this item. PUBLIC NOTIFICATION AND COMMENTS: A public notice was published in The Tribune on Wednesday, August 12, 2020 stating that at the close of the nomination period, there were not more candidates than offices to be elected. Public correspondence received regarding this item is included as Attachment 4. The Agenda was posted at City Hall and on the City’s website in accordance with Government Code Section 54954.2. I have a concern about the ethics in the hierarchy of the City of Arroyo Grande. No more lip service. These issues, true or false, need to be addressed and Corrective Action Plans (CAP) put in place so these problems do not surface again. It also seems that you need an independent committee of citizens that can review the CAP for adherence and compliance. We've gone thru too many City Managers and other staff - when a new employee comes on board to a management position, it can easily take 3 to 6 months for them to orient to their new environment. Several residents of AG have a desire to run and I would like to hear there thoughts on issues facing AG and have an opportunity to 'write-in' my vote. I understand that this will involve money, but again that is money I have contributed thru my taxes.
