Minutes 2020-09-22 ACTION MINUTES REGULAR MEETING OF THE CITY COUNCIL TUESDAY, SEPTEMBER 22, 2020 COUNCIL CHAMBERS, 215 E. BRANCH STREET ARROYO GRANDE, CALIFORNIA In compliance with the State Shelter at Home Order due to the coronavirus pandemic, and as allowed by the Governor's Executive Order N-29-20, which allows for a deviation of teleconference rules required by the Ralph M. Brown Act, this meeting was held by teleconference. 1. CALL TO ORDER Mayor Ray Russom called the Regular City Council Meeting to order at 6:00 p.m. via teleconference. 2. ROLL CALL City Council: Council Members Lan George, Jimmy Paulding, Kristen Barneich, Mayor Pro Tern Keith Storton, and Mayor Caren Ray Russom were all present via teleconference. Staff Present: City Manager Whitney McDonald, Assistant City Manager/Public Works Director Bill Robeson, Director of Legislative and Information Services/City Clerk Kelly Wetmore, Police Chief Mike Martinez, Sergeant Jeremy Burns, and Information Technology Manager Walt Cuzick were present in the Council Chambers. City Attorney Timothy Carmel, Administrative Services Director Mike Stevens, Director of Recreation Services Sheridan Bohlken, and City Engineer Robin Dickerson were present via teleconference. 3. MOMENT OF REFLECTION 4. FLAG SALUTE Council Member Barneich led the flag salute. 5. AGENDA REVIEW None. 5.b. Ordinances Read in Title Only. Mayor Ray Russom moved, Council Member George seconded, and the motion passed unanimously by roll-call vote that all ordinances presented at the meeting shall be read by title only and all further readings be waived. 6. SPECIAL PRESENTATIONS 6.a. Update Regarding Countywide COVID-19 Efforts. Recommended Action: Receive update, accept public comments, discuss, and provide direction, as necessary. City Manager McDonald provided a brief update on local COVID-19 efforts and stated that the County has been downgraded to the lower level red tier and that more businesses are now Minutes: City Council Meeting Page 2 Tuesday, September 22, 2020 allowed to open including personal care, nail salons, tattoo studios, and massage therapy. She reported that restaurants, places of worship, movie theatres, gym and fitness centers are allowed to re-open with limitations on the amount of people allowed indoors, and schools can open for in- person instruction once the County has been in the red tier for two weeks. She stated that the County Health Officer urges residents to remain vigilant and to continue to practice social distancing and to wear face coverings. Brief discussion ensued regarding in-person Council meetings in the Chambers and City Manager McDonald stated that at this time it is not recommended under the current guidelines and restrictions for gatherings of ten or more people Mayor Ray Russom invited public comment. No public comments were received. 6.b. Mayor's Commendation Recognizing Heidy Mangiardi for her Donation to the City's Enrichment Lab Distance Learning Program. Mayor Ray Russom presented a Commendation in recognition of Heidy Mangiardi's generous donation to the City of Arroyo Grande to benefit the Enrichment Lab Distance Learning Program which will be utilized to provide scholarships to children who otherwise could not participate due to financial need. Recreation Services Director Bohlken accepted the Commendation via teleconference on behalf of Heidy Mangiardi. Mayor Ray Russom noted that she would be presenting the Commendation to Heidy at her Thursday night fitness class at Heritage Park. 6.c. Honorary Proclamation Declaring October 4-10, 2020 as "Fire Prevention Week". Mayor Ray Russom presented an Honorary Proclamation declaring October 4-10, 2020 as "Fire Prevention Week". Mayor Pro Tem Storton accepted the Proclamation on behalf of the Five Cities Fire Authority in his capacity as a member of the Board. 6.d. Presentation from San Luis Obispo Council of Governments-"Rideshare Pavement to Parks". Peter Williamson, SLOCOG Program Coordinator, gave a presentation regarding the transformation of public spaces into parklets, announced that SLOCOG is offering a $300 sponsorship to businesses who would like to improve their parklets, and encouraged participation in "International Walk to School Day" on October 7, 2020. 6.e. Presentation Regarding Police Department Field Training Program. Recommended Action: Receive and file. Chief Martinez provided introductory comments and stated this was a follow up of the Department's presentation that was given on August 25, 2020. Sergeant Burns presented an overview of the Police Department Field Training Program. Staff responded to questions from Council. Mayor Ray Russom invited public comment. COMMUNITY COMMENTS AND SUGGESTIONS Mayor Ray Russom invited public comment. Speaking from the public via teleconference was Jay Parmar, a Junior at Arroyo Grande High School, regarding the STEM Club and its goal to seek betterment of the community, and said that the Club is in need of available unoccupied space or resources to help the Club. No further public comments were received. Mayor Ray Russom requested that City Manager McDonald follow up with Mr. Parmar to get more information regarding the Club's needs for available space. 8. CONSENT AGENDA Mayor Ray Russom asked the Council if there were any questions or any items to be pulled from the consent agenda for further discussion. Council Member Barneich stated she had questions regarding Item 8.k., and Mayor Pro Tern Storton stated he had questions regarding Items 8.e., 8.h. and 8.k. Mayor Pro Storton referred to Item 8.e. (Appointment to Downtown Parking Advisory Board) and acknowledged Ms. deLaney's willingness to serve on the Board. In response to a request by Mayor Pro Tem Storton regarding Item 8.h. (Consideration of Adoption of the 2020 Update to the Multi-Jurisdictional Hazard Mitigation Plan), City Manager McDonald provided an overview of the 2020 Update to the Multi-Jurisdictional Hazard Mitigation Plan. In response to questions by Council Member Barneich regarding Item 8.k. (Castillo de Mar Extension Project), City Engineer Dickerson provided an overview of how much the developer is paying for the project for purchase of the land, construction of the public improvements, agricultural mitigation, and design; how much funding the City has contributed to the project; how much funding the Lucia Mar Unified School District is providing to the project; when the project will be completed; and how the project will help traffic flow during school hours. Mayor Ray Russom invited public comment on the consent agenda. No public comments were received. Action: Council Member Barneich moved to approve Consent Agenda Items 8.a. through 8.k., with the recommended courses of action. Council Member George seconded, and the motion passed on the following roll-call vote: AYES: Barneich, George, Paulding, Storton, Ray Russom NOES: None ABSENT: None 8.a. Consideration of Cash Disbursement Ratification. Action: Ratified the listing of cash disbursements for the period September 1, 2020 through September 15, 2020. 8.b. Consideration of Statement of Investment Deposits. Action: Received and filed the attached report listing of investment deposits of the City of Arroyo Grande, as of August 31, 2020, as required by Government Code Section 53646(b). Action: Approved the minutes of the Regular City Council Meeting of September 8, 2020, as submitted. 8.d. Consideration of Conflict of Interest Code Biennial Review and Resolution Amending the City of Arroyo Grande Conflict of Interest Code. Action: Adopted a Resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE APPROVING AN AMENDED CONFLICT OF INTEREST CODE FOR DESIGNATED POSITIONS". 8.e. Consideration of Appointment to the Downtown Parking Advisory Board. Action: Approved the recommendation of Council Member Barneich to appoint Elizabeth deLaney to the Downtown Parking Advisory Board. 8.f. Adoption of a Resolution Declaring a Continued Local Emergency Related to the Coronavirus (COVID-19) Pandemic. Action: Adopted a Resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE DECLARING A CONTINUED LOCAL EMERGENCY RELATED TO THE CORONAVIRUS (COVID-19) PANDEMIC". 8.g. Consideration of Rotational Schedule for the South County Chambers of Commerce Monthly Arroyo Grande Business Meeting. Action: Approved the list of City Council rotational assignments for attending the South County Chambers of Commerce monthly Arroyo Grande Business Meeting. 8.h. Consideration of Adoption of the 2020 Update to the Multi-Jurisdictional Hazard Mitigation Plan. Action: Adopted a Resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE ADOPTING THE 2020 UPDATE TO THE SAN LUIS OBISPO COUNTY MULTI- JURISDICTIONAL HAZARD MITIGATION PLAN". 8.i. Consideration to Approve Amendments to Consultant Service Agreements for Civil Engineering, Construction Management, Materials Testing, and Land Surveying Services. Action: Approved Amendments to Consultant Services Agreements to extend agreements through June 30, 2021, with the following firms for specified services: Earth Systems Pacific; MNS Engineers Inc.; Wallace Group; Michael K Nunley and Associates; and Eikhof Design Group. 8.j. Monthly Water Supply and Demand Update. Action: Received and filed the monthly Water Supply and Demand Report. 8.k. Consideration to Adopt a Resolution Approving Construction Plans and Specifications, Authorizing Solicitation of Bids, and Confirming the Environmental Determination for the Castillo Del Mar Extension Project, PW 2020-05. Action: Adopted a Resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE APPROVING CONSTRUCTION PLANS AND SPECIFICATIONS, AUTHORIZING SOLICITATION OF BIDS, AND CONFIRMING THE ENVIRONMENTAL DETERMINATION FOR THE CASTILLO DEL MAR EXTENSION PROJECT, PW 2020-05". 9. Consideration and Discussion of Top 10 Council Priorities for Fiscal Year 2020- 2021. City Manager McDonald presented the staff report and recommended that the Council discuss, modify as necessary, and approve the Top 10 Council Priorities for Fiscal Year 2020-2021. Staff responded to questions from Council. Mayor Ray Russom invited public comment. Speaking from the public via teleconference were: Jocelyn Brennan, President/CEO of the South County Chambers of Commerce, regarding economic development and support for business recovery and assistance; and Peter Williamson, Arroyo Grande resident, who commented on Priority Item 1 as it relates to support for permanent placement of parklets, Priority Item 6 as it relates to support for completion and adoption of an updated Circulation Element, and Priority Item 10 as it relates to recruitment, retention and the promotion of diversity, equity, and inclusion. No further public comments were received. Action: Council Member Paulding moved to approve the Top 10 Council Priorities for Fiscal Year 2020-21, with the following modifications: 1) add discussion regarding CARES Act funds as a priority item to occur in October 2020; and 2) modify #9 to receive an update and review of the future of the Brisco Interchange Project by the end of 2020. CITY COUNCIL REPORTS The City Council provided brief reports from the following committee, commission, board, or other subcommittee meetings that they attended as the City's appointed representative.
