R 1518 U(jll ~. "'"'" ..J RESOLUTI ON NO. 1518 . A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE ESTABLISHING THE NEGOTIATED EXCHANGE OF PROPERTY TAX REVENUE BASE BETWEEN THE CITY OF ARROYO GRANDE AND THE COUNTY OF SAN LUIS OBISPO WHEREAS, pursuant to Revenue and Taxation Code Section 99(b) (as added by AB 8 and AB 1019), in case of jurisdictional changes (other than city Incorporations or district formations), It Is required that the amount of current property tax revenue base (hereinafter referred to as "Current PTRB") and to be exchanged amount affected agencies shall be determined by negotiation; and WHEREAS, the City of Arroyo Grande will have Increasing future responsibility for the area affected. The City shall be entitled to a portion of the Incremental future growth of the property tax revenue base; and WHEREAS, when a city is involved, the negotiation is between the city and the Board of Supervisors for the County; and WHEREAS, when a district but no city is Involved, the Board of Supervisors of the County negotiates on behalf of both the districts and the County; and WHEREAS, said Section 99(b) requires that negotiating parties by resolution agree to accept the negotiated exchange of Current PTRB between affected agencies and requires that a copy of each such resolution be transmitted to the County Auditor; and WHEREAS, upon receipt of the necessary resolutions and a copy of the recorded certificate of completion from LAFCo, the County Auditor is required by Revenue and Taxation Code Section 99(b) to make appropriate adjustments; and WHEREAS, such negotiation has taken place concerning transfer of Current PTRB between the City of Arroyo Grande and the County of San Luis Obispo pursuant to said Section 99(b) for the Jurisdictional change designated as the Stem Annexation to the City of Arroyo Grande; and WHEREAS, the negotiating/consulting partIes, to wit: Kerry E. Harms, Deputy County Administrator on behalf of the County of San Luis Obispo and William Sheldon, Jr., City Administrator, on behalf of the City of Arroyo Grande have agreed to accept the negotiated exchange of Current PTRB between such entities as set forth hereinafter; and WHEREAS, it is In the public Interest that such negotiated Current PTRB exchange be consummated. ,. NOW, THEREFORE, BE IN RESOLVED by the City Council of the City of Arroyo Grande as follows: 1- That the recitals set forth hereinabove are true, correct and valid. 2. That the City of Arroyo Grande agrees to accept the negotiated exchange of Current PTRB in the amount of $ zero shall be transferred from the County of San Luis Obispo and such amount shall be transferred to the City of Arroyo Grande In the Fiscal Year 1982-83. __.__nn____ --~------ ---------...----- - .- 081 3. The City of Arroyo Grande share in the incremental growth of the property tax revenue base shall be based on the average the City received in other tax rate areas in its jurisdiction. The City's average in 1982-83 is 20.46675. 4. Upon receipt of a certified copy of this Resolution and a copy of said recorded certificate of completion, the County Auditor shall, pursuant to said Section 99(b), make adjustments (negotiated exchange of Current PTRB) as set forth in Paragraph #2 hereinabove. 5. The City Clerk be and is hereby authorized and directed to forward a certified copy of this Resolution to the San Luis Obispo County Local Agency Formation Commission, Executive Officer, who shall then disseminate copies thereof as required by law.
