R 1497 057 ---- -.. , , - RESOLUTI ON NO. 1497 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE REQUESTING THE LEAGUE OF CALIFORNIA CITIES TO SPONSOR LEGISLATION WHICH WOULD PROVIDE LOCAL GOVERNMENTS WITH THE ABILITY TO EXERCISE MORE CONTROL OF BUSINESS ESTABLISHMENTS THAT SELL ALCOHOLIC BEVERAGES WHEREAS, the consumption of alcoholic beverages contributes significantly to crime problem~ in the community; and [ WHEREAS, local ~tandards and needs regarding the sales of alcoholic beverages and the control of premises are often not considered; and WHEREAS, local government's principle means of controlling where alcoholic beverages will be sold is through zoning ordinances; and WHEREAS, zoning o-dlnances may not be an adequate or appropriate manner to control where alcoholic b~)lerages ~In. be sold; and , . WHEREAS, local government is c;.hargeciwith'keeping order in the conmunity and that in some instances the location or the conduct of a business sel1ing alcoholic beverages may,be contrary to that charge; and WHEREAS, existing law does not provide local government with sufficient authority to control the proliferation of licensees or to exercise control over licensed premises which are long term sources of criminal activity; and \ WHEREAS, the 10~'foot rule as outlined in rule 61.4 of the State of California Department of Alcoholic Beverage Control prior to its amended form is an example of the legislation needed to assist local government on , matters relating to where alcoholic beverages may be sold; and WHEREAS, a more profound application of contemporary community standards doctrine needs to be applied to alcoholic beverage licensing and license control; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arroyo Grande that the League of California Cities is urged to support legislation which would expand the control of local government on matters dealing with alcoholic beverage licensing and license control. On motion of Council Member Millis, seconded by Council Member Vandeveer, and on the following roll call Ivote, to wit: AYES: Council Members Smith, Millis, Vandeveer, Mayor Pope [ NOES: Council Member Hogan ABSENT: None the foregoing Resolution was passed and adopted this 25th day of August, 1981.
