R 1489 . - ') 045 r --,' RESOLUTI ON NO. 1489 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, NOVEMBER 3, 1981, FOR THE SUBMISSION TO THE QUAUFIED ELECTORS OF SAID CITY AN ORDINANCE RELATING TO REZONING CERTAIN PROPERTY KNOWN AS GRANDE HIGHLANDS WHEREAS, the City Counc 11 of the City of Arroyo Grande did on [ January 27, 1981 duly adopt Ord.inance No. 243 C.S. providing for the reiloning of certain property known as Grande Highlands; and ,WHEREAS, the said Ordinance was duly published as required by I aw; and WHEREAS, pursuant to authority provided by statute a petition has been filed with the legislative body of said city signed by more than ten percent .of the number of qualified registered voters of said city protesting the adoption of the hereinabove ordinance' referred to; and WHEREAS, the City Clerk of said city has duly examined and from the records of registration ascertained that the petition' is signed by the requisite number of voters, and has so certified; and WHEREAS, the City Council of said city has not voted in favor of repeal of the ordinance; and WHEREAS, the City Counc il of sa i d city is thereupon author i zed and directed by statute to submit the Ordinance to the qualified voters; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE, CAUFORNIA,DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECT! ON J: That pursuant to the requirements. of the laws of the State of Cal ifornia relating to General Law Cities within said State, there shall be, and there is hereby called and ordered held in the City of Arroyo Grande, County of San Lui's Obispo, on Tuesday, November 3, 1981, a Special Municipal Election of the qualified electors of said city for the purpose of submitting' the following proposed ordinance, to wit: Shall the ordinance amending a portion of the zoning map of the City of Arroyo Grande referred to in Section .302 of Title 9, Chapter 4, of the Municipal Code so as YES to rezone certain property in the City of Arroyo Grande known as Grande NO Highlands from "A" Agricultural to [ "P_D" Planned Development zone be adopted? SECTI ON 2: The proposed ordinance submitted to the voters is as fol1ows: Ordinance No. 243 C.S., An Ordinance of the City of Arroyo Grande Amending a Portion of the Zoning Map of the City of Arroyo Grande Referred to in Section .302 of Title 9, Chapter 4, of the Municipal Code so as to Rezone Certain Property in the City of Arroyo Grande Known as Grande Highlands. SECTI ON 3: That the ballots to be used at said election shall be, both as to form and matter contained herein, such may be required by law to be used thereat. , .<,. ~ ""'-':". .., 046 .. .- ~ - SECTION 4: That the polls for said election shall be open at seven o'clock a.m. of the day of said election and shall remain open continuously from said time until eight o'clock p.m. of the same day when said polls shall be closed, except as provided in Section 14301 of the Elections Code of the State of California. SECTI ON 5: That the City Council hereby declines to adopt Section 5014.5 of the Elections Code of the State of California providing for Rebuttal Arguments. SECTION 6: That in all particulars not recited in this Resolution, said election shall be held and conducted as provided by law for holding I municipal elections in said city. SECTI ON 7: That not ice of the t i.me and p lace of hold i ng sai d election is hereby given and the City Clerk is hereby authorized, instructed and directed to give' such further or additional notice of said election in time, form andl:manner as provided by law. SECTI ON 8: That the City Clerk shall certify to the passage and . adoption of this Resolution; shall enter the same in the book of original Resolutions of said City; and shal1 make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which time the same is passed and adopted.. SECTION 9: That this Resolution shall take effect immediately. On motion of Council Member Smith, seconded by Council Member Vandeveer, and on the following roll call vote, to wit: AYES: Council Members Smith, Hogan, Millis, Vandeveer, Mayor Pope NOES: None ABSENT: None the foregoing Resolution was passed and adopted this 6th da of August, 1981.
