R 1488 :> 043 ,...... .- RESOLUTION NO. 1488 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE,CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, .NOVEMBER 3, 1981, FOR THE SUBMISSION TO THE QUALIFIED VOTERS OF SAID CITY AN ORDINANCE RELATING TO PREZONING CERTAIN UNINCORPQRATED iERRITORY ADJOINING THE CITY OF ARROYO GRANDE KNOWN AS THE WELLS PROPERTY ( WHEREAS, the City Council of the City of Arroyo Grande did on January.13, 1981 duly adopt Ordinance No. 239 C.S. providing for the prezoning of certain unincorporated territory adjoining the City of Arroyo Grande known as the Wells Property; and WHEREAS, the said Ordinance was duly published as required by law; and 'WHEREAS, pursuant to authority provided by statute a petition has been filed with the legislative body of said city signed by more than ten percent of the.number of qualified regist.ered voters of said city protesting the adoption of.the hereinabove ordinance referred to; and WHEREAS, the City Clerk of said city' has duly examined and from the records or registration ascertained that the petition is signed by the -requisite number of voters., and has so certified; and WHEREAS, the City Council of said city has not voted In favor of the repeal of the ordinance; and WHEREAS. the City Council of said city is ther.eupon. authorized and directed by statute to submit the Ordinance to the qualified voters; . NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE, CALIFORNIA, :DOES HEREBY RESOLVE, DECLARE, . DETERMINE AND ORDER AS FOLLOWS: SECTION I: That pursuant to the requirements of the laws of the State cif California relating to General Law Cities within said State, there shall be, and there is hereby called and ordered held in the City of Arroyo Grande, County of San Luis Obispo, State of California, on Tuesday, November 3, 1981, a Special Municipal Election of the qualified electors of said City for the purpose of submitting the following proposed ordinance, to wit: Shall the ordinance prezoning certain unincorporated territory adjoining the City of Arroyo Grande to "P-D" Planned YES . Development District, pursuant to Government NO Code Section 65859 and Arroyo Grande ( Municipal Code Section 9-4.3209 known as the Wells Property be adopted? SECTION 2: The proposed ordinance submitted to the voters is as follows: Ordinance No. 239 C.S., An Ordinance of the City of Arroyo Grande Prezoning Certain Unincorporated Territory Adjoining the City of Arroyo Grande Pursuant to Government Code Section 65859 and Arroyo'Grande Municipal Code Section 9-4,3209. SECTION 3: That the ballots to be used at said. election shall be, both as to form and matter contained herein, such may be required by law to be used thereat. , 1.- - B"'~ .'"..~r . ~ , . .... . , --". - --- . . . .... r T . -- - - SECTION 4: That the polls for said etection shall be open at seven o'clock a.m. of the. day of said election and shalt remain open continuously from said time until eight o'clock p.m. of the same day when said polts s~al1 be closed, except as provided in Section 14301 of the Elections Code of the State of California. SECTION 5: That the City Council hereby dec1ines to adopt Section 5014.5 of the Elections Code of the State of California providing for Rebuttal Arguments. SECTION 6: That in all particulars not recited tn this Resolution, said election shall be held and conducted as provided by law for holding municipal elections in said city. I SECTI ON 7: That notice of the time and place of holding said election is hereby given and the City Clerk is hereby authorized, instructed and directed to give such further or addiltionalnotice of said etection in time, form and manner as provided by law. SECTION 8: That the City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original Resolutions of ,said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which time the same is passed and adopted. SECTION 9:'That this Resolution shatl take effect immediately.'
