RESOLUTION NO. 1481
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ARROYO GRANDE ELIMINATING THE REQUIREMENT
OF REFERRAL TO' PLANNING COMMISSION IN MATTERS
INVOLVING STREET WIDENING OR ALIGNMENT PROJECTS
OF A MINOR NATURE
WHEREAS, Government Code Section 65402 provides for referral
of matters involving acquisition and abandonment of property to a city's
planning commission; and
WHEREAS, said section states that if the city council so provides, I
by ordinance or resolution, the provisions of that section shall not
apply to 1) the disposition of the remainder of a larger parcel which
was acquired and used in part for street purposes; 2) acquisitions,
dispositions, or abandonments for street widening; or 3) alignment projects,
provided such dispositions for street purposes, acquisitions, dispositions
or abandonments for street widening, or alignment projects are of a minor
nature;
NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED by the City
Council of the City of Arroyo Grande, pu(suant to Government Code Section
65402, the provisions of subsection (a) thereof shall not apply to 1) the
disposition of the remainder of a larger parcel which was acquired and
used in part for street purposes; 2) acquisitions, dispositions, or
abandonments for street widening; or 3) alignment projects, provided
such dispositions for street purposes, acquisitions, dispositions or
abandonments for street widening or alignment projects are of a minor
nature.
On motion of Council Member Hogan, seconded by Council Member
Vandeveer, and on the following roll call vote, to wit:
AYES: Council Members Smith, Hogan, Millis, Vandeveer, and Mayor Pope
NOES: None
ABSENT: None
the foregoing Resolution was passed and adopted this 23rd day of June, 1981. c
