CC 2021-07-27_08k Consultant Services Agreement_WSC and NCMA MEMORANDUM TO: CITY COUNCIL FROM: BILL ROBESON, ASSISTANT CITY MANAGER/PUBLIC WORKS DIRECTOR BY: SHANE TAYLOR, UTILITIES MANAGER SUBJECT: CONSIDERATION TO APPROVE A CONSULTANT SERVICES AGREEMENT WITH WATER SYSTEMS CONSULTING, INC. TO PROVIDE STAFF EXTENSION SERVICES FOR THE NORTHERN CITIES MANAGEMENT AREA TECHNICAL GROUP FOR FIVE YEARS DATE: JULY 27, 2021 SUMMARY OF ACTION: Approving a Professional Services Agreement with Water Systems Consulting, Inc. (WSC) for 8/1/2021 through 8/1/2026 will allow continued support service for the Northern Cities Management Area (NCMA) Technical Group. IMPACT ON FINANCIAL AND PERSONNEL RESOURCES: The approved FY 2021-23 budget includes $43,200 for FY 2021/22 and $44,500 for FY 2022/23 for Arroyo Grande’s cost share of the service. Staff spends approximately 120 hours/year on the NCMA Technical Group activities. RECOMMENDATION: It is recommended the City Council approve a Consultant Services Agreement with WSC, Inc. for a term of five (5) years in the not to exceed amount of $32,000.00 each year. BAC KGROUND: A request for proposals for staff extension services was completed in May, 2021. Water Systems Consulting, Inc. (WSC, Inc.) was chosen by the Northern Cities Management Area (NCMA) Technical Group to provide these services for a five-year period. The attached proposal provides a work scope and fee schedule. The five-year Professional Services Agreement with WSC, Inc. for staff extension services for the NCMA expired on 7/1/2021. The previous request for proposals was completed by the City of Pismo Beach in 2016 for the NCMA. Arroyo Grande issued a RFP in May 2021 for staff extension services for the NCMA for the next five (5) years. Six (6) local firms were solicited along with two (2) firms in the Bay Area, including Todd Groundwater. Todd Groundwater provided services for the NCMA previous to WSC, Inc. The RFP was also placed on our City website. Only one proposal was received from WSC, Inc. TO PROVIDE STAFF EXTENSION SERVICES FOR THE NORTHERN CITIES MANAGEMENT AREA TECHNICAL GROUP FOR FIVE YEARS JULY 27, 2021 PAGE 2 reviewed the proposal and found it to be complete and recommended WSC, Inc. be considered for a five-year agreement. ANALYSIS OF ISSUES: The NCMA technical group meets monthly to review, analyze, and make recommendations on groundwater management data. The group also coordinates regional water management activities and assures all required reporting is completed for the Superior Court per the stipulation of the adjudication of the Santa Maria Groundwater Basin. All these efforts require coordination, agenda preparation, research, technical review and various related work products. In 2005 through 2009 the NCMA technical group would meet and confer on Groundwater Conditions and Management of the NCMA along with preparation of the Annual Report to the Superior Court. It was concluded that the staff time required to properly conduct the management of the NCMA could not be met with in-house staff from Grover Beach, Pismo Beach, Oceano Community Services District and Arroyo Grande. As a result, a consultant was awarded, by each individual agency, an agreement for staff extension services to help manage the NCMA and all the required work product for the ongoing effort to manage the basin. A complete list of work tasks is in the attached RFP under Scope of Services. As the NCMA is not a governing organization, each City and OCSD enter into its own agreement to pay its share of the expenses. The term of the agreement is for five years. The budget for FY 2021/23 includes $43,200 for FY 2021/22 and $44,500 for FY 2022/23. These amounts were derived from the previous year with a 3% adjustment, as the cost proposal had not been received prior to the budget figures having to be placed into the proposed two-year budget. The actual amount from the cost proposal for Arroyo Grande is $26,821.20. This amount plus a 20% contingency brings the total to $32,000.00. The contingency is for the possible need to complete modeling calculations of the basin in the coming years. The cost share for the service is based upon the percentage of groundwater entitlement in the current Agreement Regarding the Management of the Arroyo Grande Groundwater Basin. Arroyo Grande’s share of cost is 31%. ADVANTAGES: Approval of this agreement will allow continued support services to the NCMA Technical Group, which are imperative for efficient operation. DISADVANTAGES: No disadvantages noted at this time other than the expense of $32,000 each year to provide the service. Do not approve staff’s recommendation; or 3. Provide direction to staff. ENVIRONMENTAL REVIEW: No environmental review is required for this item. PUBLIC NOTIFICATION AND COMMENTS: The Agenda was posted at City Hall and on the City’s website in accordance with Government Code Section 54954.2. Attachments: 1.
