R 1439 u.u /' '1 -/ RESOLUTION NO. 1439 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE FINDING AND DETERMINING THAT SERGEANT ROY LAWRENCE GIBSON IS INCAPACITATED AS A RESULT OF AN INDUSTRIAL INJURY AND THAT HE SHOULD BE RETIRED WHEREAS, the City of Arroyo Grande (hereinafter referred to as Agency) is a contracting agency of the Public Employees' Retirement System; and WHEREAS. Public Employee Retirement Law requires that a contracting agency determine whether an employee of such agency, classified as a local safety member, is disabled for purposes of the Public Employees' Retirement Law and whether such disability is lIindustrialll within the I meaning of such law; and WHEREAS, an application for disability retirement of Roy Lawrence Gibson, employed by the Agency in the position of Sergeant, has been filed with the Public Employees' Retirement System; and WHEREAS, The Council of the City of Arroyo Grande has reviewed the medical and other evidence relative to such disability; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE, as follows: 1. That this Council hereby finds and determines that Sergeant Roy Lawrence Gibson is incapacitated within the meaning of the Public Employees Retirement law for the performance of his duties; 2. That this Council finds and determines that such disability is a resu1t of injury or disease arising out of and'in the course of employment, and neither said Roy Lawrence Gibson nor the Agency has applied to the Workmen's Compensation Appeals Board for a determination pursuant to Section 21026 that such disability is industrial; and 3. That the effective date of Sergeant Roy Lawrence Gibson's retirement shall be December I, 1980. On motion of Council Member Smith, seconded by Council Member Hogan, and on the following roll call vote, to wit: AYES: Council Members Smith, Hogan, Millis, Vandeveer, and Mayor Pope NOES: None ABSENT: None the foregoing Resolution was passed and adopted this 28th day of October, 1980.
