RESOl.UTION NO. 1426
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO
GRANDE ACCEPTING NEGOTIATED EXCHANGE OF PROPERTY TAX
REVENUE BASE FROM THE CITY OF ARROYO GRANDE TO THE COUNTY I
OF SAN l.UIS OBISPO i
The following resolution is hereby offered and read:
WHEREAS, pursuant to Revenue and Taxation Code Section 99 (b) (as added
by AB 8 and AB 1019), in case of jurisdictional changes (other than city Incorporations
or district formations), it is required that"the amount of property tax revenue
base hereinafter referred to as "PTRB") to be exchanged among affected agencies ~hall !
be determined by negotiation; and ~
WHEREAS, when a city is involved, the negotiation is between the city
and the Board of Supervisors for the County; and
WHEREAS, said Section 99 (b) requires that negotiating p~rties by resolution
agree to accept the negotiated exchange of PTRB between affected agencies and requires
that a copy of each such resolution be transm1tted to the C-Ounty Auditor; and

WHEREAS, upon receipt of the necessary resolutions and a copy of the ~
recorded certificate of completion from LAFCO, the County Auditor is required by ,
,
Revenue and Taxation Code Section 99 (b) to make appropriate adjustments; and ,

WHEREAS, such negotiation has taken place concel'ning transfer of I'TRB
between the County of San l.uis Obispo and the City of An'oyo Grand", pUI"suanl to
said Section 99 (b) for the jurisdictional change designated as Tract 652 Annexation
to the City of Arroyo Grande; and
WHEREAS, the negotiating/consulting parties, to wit: Kent Taylor on behalf
of the County of San Luis Obispo, arid Thomas M, butch on behi!1f of the City of
Arroyo Grande have agreed to accept the negotiated exchange of PTRfi between such
entities as forth hereinafter; ano

110\,1, THEREFORE, BE IT RESOLVED AND GRDEHED by the City Council of the City
of Arroyo Grande. as follows:
1, That the recitals set forth hereinabove are 'Tue, correct and val id. I
2, That the.City of Arroyo Grande herein agrees to accept the followin!)
negotiated exchange of PTRB:
a. PTRB in the amount of zero shall be transferred f!"Om the County of
San Luis Obispo, and such amount shall be tra<>sfe:,..."d to the City of Arroyo (;ranrle, ~
in the fiscal year 1981-82.
3" Upon receipt of a certified copy vi this Resolution and a copy of said
recorded certificate of completion, the County Auditor shall, pursuant to said
Section 99 (b), make the adjustmenls (negct;~t"d oX change of PTRB) as set forth
in Paragraph #2 hereinabove.

certified copy of this Resolution to the San Luis Obispo County Local AgenGY Formation
Commission, Executive Officer, who shall then disseminate copie~ thereof as required
by Jaw,
