A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO
GRANDE, RESCINDING REJECTION AND ACCEPTING AN OFFER OF
DEDICATION FOR STREET, DRAINAGE, SLOPE AND PUBLIC UTILITY
EASEMENTS AND PUBLIC IMPROVEMENTS FOR CASTILLO DEL
MAR AS SHOWN ON PARCEL MAP AG PM 06-0004 AND
CONSTRUCTED BY JJ FISHER CONSTRUCTION, INC.
WHEREAS, the City Council approved Parcel Map AG PM 06-0004 on August 11, 2009
and rejected without prejudiced the offer of dedication shown on the referenced parcel
map for streets, drainage, slope and public utility easements; and
WHEREAS, Final Parcel Map AG PM 06-0004 was recorded by the County Recorder on
May 31, 2011; and
WHEREAS, the City Council awarded the construction of the Castillo Del Mar Extension
Project improvements on January 12, 2021 to J.J. Fisher Construction, Inc.; and
WHEREAS, J.J. Fisher Construction, Inc. has constructed and completed the
improvements per the approved plans and specifications for the Castillo Del Mar
Extension Project on schedule; and
WHEREAS, City staff inspected the improvements on February 14, 2022 and find they
are constructed in accordance with the approved plans for the Castillo Del Mar Extension
Project; and
WHEREAS, per Government Code Section 6647.2 (a), the offer of dedication shall
remain open and the legislative body may by resolution at any later date, and without
further action by the subdivider, rescind its action and accept the offer of dedication, which
acceptance shall be recorded in the Office of the County Recorder.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Arroyo
Grande hereby:
1. Rescinds its rejection of an offer of dedication for street, drainage, slope and public
utility easements on August 11, 2009; and
2. Accepts the offer of dedication for street, drainage, slope and public utility
easements for Castillo Del Mar as shown on final Parcel Map AG PM 06-0004
recorded May 31, 2011 and attached hereto for reference; and
3. Accepts the improvements for the Castillo Del Mar Extension Project.
