RESOLUTION NO. 1328
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO
GRANDE CONFIRMING THE REPORT OF THE SUPERINTENDENT OF
STREETS AND LEVYING ASSESSMENT FOR THE INSTALLATION OF
CONCRETE CURBS, GUTTERS ANO ORIVEWAY APRONS & CONFORMANCE.
WHEREAS, pursuant to the provisions of the "Improvement Act of 1911", being
Division 7 of the Streets and Highways Code of the State of Cal ifornia, the Super-
intendent of Streets did on the 10th day of August, 1977, notify the owners or
persons in possession of those certain properties within the City of Arroyo Grande,
California, located on the north side of The Pike between South Elm Street and the
west;:IY City Limits, to cause certain installation of concrete curbs, gutters and
drlv ay aprons & conformance to be made adjacent to the hereinabove located
properties; that the owners or persons in possession, so notified, failed and
neglected to cause said Installation to be made; and that the Superintendent of
Streets proceeded to have said installation done and made at a total cost of
Seven Thousand Seven Hundred Ninety-Two Dollars and Forty-Two Cents ($7,792.42); and
WHEREAS, the said Superintendent of Streets, upon the completion of said
installation, filed with this City Council his report upon said installation and
costs thereof, and gave notice to the owners or persons in possession of said
properties hereinabove referred to, in the time, form and manner prescribed by law,
that the hour of 8:00 P.M. on the 22nd day of August, 1978, was the hour fixed for
hearing upon said report; and evidence having been received thereon.
NOW, THEREFORE, IT IS HEREBY RESOLVEO BY THE CITY COUNCIL OF THE CITY OF
ARROYO GRANDE, as follows:
SECTION 1. That all notices have been given as provided by law and required
by the provisions of the "Improvement Act of 1911" and that the report of the
Superintendent of Streets upon the installation be, and It Is hereby confirmed.
SECT! ON 2. That an assessment in the amount of $7,792.42 representing the
installation made by the Superintendent of Streets against the properties herein-
above described is hereby made and confirmed; and the Superintendent of Streets
is hereby directed to notify such owners or persons in possession of said properties
of said assessment.
SECTION 3. That if the owners or persons In possession of said properties
fai 1 to pay said assessment within five (5) days from date hereof, as provided by
law, or enter into an agreement with the City of Arroyo Grande to pay said
assessment over a period of time not to exceed three years, at an annual interest
rate of six percent (6%), the Superintendent of Streets shall record a Notice of
Lien in the Office of the County Recorder of the County of San Luis Obispo.
