A RESOlUT~ON OF THE CITY COUNC~l OF THE CITY OF ARROYO
GRANDE FINOING AND DETERMINiNG THAT LIEUTENANT ROBERT D,
RIPLEY IS iNCAPACITATED AS A RESULT OF AN INOUSTRiAl
I NJURY AND THAT HE SHOULD BE RETI RED.
WHEREAS, the City of Arroyo Grande (hereinafter referred to as Agency) t $
a contracting agency of the Public Employees' Retirement System; and
WHEREAS, Public Employee Retirement Law requires that a contracting
agency determine whether an employee of such agency, classified as a local Sii'<S'c,y
member, Is disabled for purposes of the Public Employees' Retirement Law and
whether such dhablllty Is "Industrial" within the meaning of such law; and
WHEREAS, an application for dhabll ity retl rement of Robert D. Ripley,
employed by the Agency In the position of Lieutenant, has been filed with the
Public Employees' Retirement System; and
WHEREAS, the Council of the City of Arroyo Grande has reviewed the
medical and other evidence relative to such disability.
NOW, THEREFORE, BE iT RESOLVED by the City Council of the City of Arroyo
Grande, as follows:
1. That this Council hereby finds and determines that Lieutenant Robert
D. Ripley Is Incapacitated within the meaning of the Public Employees' Retirement
Law for the performance of his duties;
2. That this Council finds and determines that such disability Is a result
of Injury or disease arising out of and In the course of employment, and neither
said Robert D. Ripley nor the Agency has applied to the Workmen's Compensation
Appeals Board for a determination pursuant to Section 21023.6 that such disability
Is Industrial; and
3. That the effective date of lieutenant Robert O. Ripley's retirement
shall be August 1, 1978.

on the following roll call vote, to wit:
AYES: Council Members Pope, Gallagher, de Leon, Smith and Mayor Millis
NOES: None
ABSENT: None
the foregoing Resolution was passed and adopted this 13th day of June, 1978.
