R 1308 c 0 RESOLUTION NO. 1308 .- A M~~&Ul.&~E OF THE CITY COUNCIL OF THE CITY OF , CALIFORNIA, ADOPTING REGU- LATIONS FOR CANDIDATES FOR ELECTIVE OFFICE, PERTAIN- ING TO MATERIALS SUBMITTED TO THE ELECTORATE AND THE COSTS THEREOF FOR lHE GENERAL MUNICIPAL ELEC- TION TO BE HELD IN SAID CITY ON TUESDAY, THE 7th DAY . OF MARCH , 19.n.... WHEREAS, Section 10012 of the Elections Code of the State of California authorizes the governing body of any local agency to adopt regulations pertaining to materials prepared by any candi- date for a municipal election, including costs thereof; and WHEREAS, it is the opinion of the Attorney General of the State of California (No. CV ~ 76/5, May 6, 1976) that a candidate may not be billed for the additional cost of .,re~g candidates' statements in Spanish if such were not requested by the candidate but were required solely by reason of recent amendments tq the Federal Voting Rights Act of 1965 (Public Law 94-73, August 6, 1975); NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE , CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That pursuant to Section 10012 of the Elections Code of the State of California, each candidate for elective office to be voted for at the General Municipal.Election to be held in the City of Arroyo Grande on the 7th day of March , 19l!..., may prepare a candidate's statement on an appropriate form provided by the City Clerk. Such statement may include the name, age and occupation of the candidate and a brief description of no more than two hundred (200) words of the candidate's education and qualifications expressed by the candidate himself. Such statement shall not include party affIliation of the candidate, nor membership or activity in partisan political organi- zations. Such statement shall be fIled in the office of the City Clerk at the time the candidate's nomination papeR are flied. Such statement may be withdrawn, but not changed, during the period for filing nomina- tion papeR and until 5:00 p.m. of the next working day after the close of the nomination period. SECTION 2. That in compliance with the recent amendments to the Federal Voting Rights Act of 1965 (Public law 94-73, August 6, 1975) the City Clerk shall provide a Spanish translation of the candidate's statement to be included in the Voter's Pamphlet and mailed with the sample ballot .to each voter in said City. : SECTION 3. That the City Clerk shall send to each voter with the sample ballot, a , voter's pamphlet which contains the statement of each candidate in English and Spanish pursuant to law. ..-.-..-r. ~ ~ SECTION 4:;rhat the City Clerk shall provide each c didate or the candidate's repre- sentative a copy of this Resolution at the time nominating petitions are issued. SECTION 5.
