A RESOLUTI0N OF THE CITY COUNCIL OF THE CITY OF ARROYO
GRANDE C0NFIRMING THE REPORT OF THE SUPERINTENDENT OF
STREETS AND LEVYING ASSESSMENT FOR THE INSTALLATION OF
CONCRETE CURBS, GUTTERS, SIDEWALKS, DRIVEWAY APRONS AND
ORIVEWAY CONFORMANCE.
WHEREAS, pursuant to the provisions of the "Improvement Act of 1911",
being Division 7 of the Streets and Highways Code of the State of Ca1ifornia,
the Superintendent of Streets did, on the 27th day of August, 1976, notify the
owners or persons in possession of those certain properties within the City of
Arroyo Grande, California, located on: both side of DEL SOL STREET, to cause
certain installation of curbs, gutters, driveway aprons and driveway conformance
to be made adjacent to the hereinabove property; that the 0Wners or persons in
possession, so notified, failed and neglected to cause said installation to be
made; and that the Superintendent of Streets proceeded to have said installation
done and made at a total cost of Sixteen Thousand One Hundred Seven Dollars and
Twenty-Six Cents ($16,107.26);
WHEREAS, said Superintendent of Streets, upon the cmmpletion of said
installation, filed with this City Council his report upon said installation
and costs thereof, and !lawe notice to the owners or persons In possession of
said properties hereinabove referred to, in the time, form and manner prescribed
by law, that the hour of 8:00 P.M. on the 14th day of June, 1977, was the hour
fixed for hearing upon said report; and evidence having been received thereon.
NeW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY CeUNCIL OF THE CITY
OF ARROYO GRANDE, as follows:
SECTION 1: .That all notices have been given as provided by law and
required by the provisions of the "Improvement Act of 1911" and that the
report of the Superintendent of Streets upon the installation be, and it is
hereby confirmed.
SECTION 2: That an assessment In the amount of $16,107.26 representing
the Installation made by the Superintendent of Streets against the praperties
hereinabove described is hereby made and confirmed; and the Superintendent of
Streets Is hereby directed to notify such owners or persons In possession of
said properties of said assessment.
SECTION J: That if the owners or persons in possession of said properties
fail ta pay said assessment within five (5) days from date hereof, as provided by
law, or enter Into !in agreeMent with' the City to pay said assessment over a period
of time not to exceed three Yfl.lU'S, at -en anifual-tnte~est rate. of six percent (6%),
the Superintendent of Streets sha11 recerd a Notice of Lien in the Office (J)f the
County I\ecorder of the County ,of San Luis Obispo.
