A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO i
GRANDE SETTING FORTH ITS INTENTION TO VACATE, ABANDON i
AND CLOSE A PORTION OF THAT CERTAIN PUBLIC UTilITY I
EASEMENT ON lOT 1 IN THE RUTH ANN WAY TRACT, IN THE i
CITY OF ARROYO GRANDE, AND FIXING TIME ANO PLACE FOR I
HEARING AS PROVIDED FOR BY GOVERNMENT CODE SECTION ,

WHEREAS, there now exists In the City of Arroyo Grande, County of San
Luis Obispo, State of CalifornIa, a 15' wide public utility easement on Lot 1
of Ruth Ann Way Tract No. 554; and
WHEREAS, the City Council of the City of Arroyo Grande elects to proceed
with the vacation, abandonment and closing of a portion of said easement,
pursuant to Section 50437 of the Government Code of the State of California; and
f WHEREAS, it appears that said easement portion Is unnecessary for present
or prospective public use, and the Arroyo Grande Planning Commission has hereto.
fore approved said abandonment; and
WHEREAS, it appears that the abandonment and closing of said easement I
portion Is for the best Interests of the public.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ARROYO
GRANDE that It intends to abandon and close the hereinafter described portion
of utility easement, In the City of Arroyo Grande, County of San Luis Obispo,
State of California. For this purpose, the City Council will hold a hearing In
connection with said Intention to vacate, abandon and close the hereinafter
described easement portion, which hearing will be held In the Council Chambers
of the City Hall at 214 East Branch Street, Arroyo Grande, California, on the .
22nd day of February, 1977, at the hour of 8:00 P.M. At said time, those j
persons Interested in or objecting to the proposed vacation, abandonment and I
closing of said easement portion may appear and be heard. 1

BE IT FURTHER RESOLVED that the City Clerk of the City of Arroyo Grande
be, and she Is herewith directed to cause to be poasted along said easement, at
intervals not to exceed three hundred feet (300') In distance apart and at least
three (3) in number on said easement, notices of passage of Resolution, which
said notices shall be entitled "NOTICE OF INTENtiON TO VACATE, ABANDON AND CLOSE
A PORTION OF AN EASEMENT ON LOT 10, TRACT 409, IN THE CITY OF ARROYO GRANDE,
COUNTY OF SAN LUIS OBISPO, STATE OF CALifORNIA".
In addition thereto, the City Clerk Is herewith ordered and directed to
i cause a copy of said Resolution to be published at least two successive weeks
1 prior to the hearing in the Five CitIes Tlmes-Press-Recorder, a semI-weekly

I newspaper published and circulated In the City of Arroyo Grande, which publica-
tion shall be at least ten (10) days prior to the date of said hearing.

. BE IT FURTHER RESOLVED that the portion of that easement In Lot 1 of
I Ruth Ann Way Tract No. 554, which the City Council of the City of Arroyo Grande
I proposes to vacate, abandon and close, Is more particularly described as follows:
I In the City of Arroyo Grande, County of San Luis Obispo,
[ State of California, the easterly 10' of the westerly
f 15' of Lot I, Tract 55~, as recorded at Page 8 Volume 9

, of Maps of said County.

I Further particulars as to the proposed vacation are shown on the map
pertaining thereto on file In the office of the City Clerk of the City of
Arroyo Grande.
On motion of Councilman Splerllng, seconded by Councilman Schlegel and
on the following roll call vote, to wit:
