. RESOLUTION NO. 1225
A RE~OLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO
GRANDE ORDERING THE ABANDONMENT OF A PORTION OF RIGHT
OF WAY ON SOUTH ELM STREET (STREETS & HIGHWAYS CODE
SECTION 8320, ET SEQ.)
WHEREAS, the City Council of the City of Arroyo Grande has elected to proceed
under provisions of Streets and Highways Code Section 8320, et seq., and in
accordance with the provisions thereof, by Resolution, the Arroyo Grande City Council
set the time and place for public hearing of protests for the vacation of said excess
right of way, at 8:00 P.M., June 22, 1976, In the Arroyo Grande City Council Chambers;
and
WHEREAS, the City Council has found, on the basis of evidence produced at the
public hearing, that the hereinafter described right of way Is unnecessary for
present or future public street purposes;
NOW, THEREFORE, BE IT RESOLVED that the hereinafter described portion of excess
right of way on South Elm Street be abandoned, and it is so ordered.
All that portion of the right of way for South Elm Street,
between Ash Street and Maple Street, lying easterly of the
East Plan Line of the "Amended Plan Line for Elm Street"
as shown on that map recorded in Book 1 of Official Plan
Lines at Page 12 in the records of San Luis Obispo County.
RESERVING THEREFROM, over the entire abandoned right of
way hereinabove described, an easement for public utility
purposes.
On motion of Counci.Juuan Spierllng, seconded by Counci I man Gal1agher and on
the following roll call vote, to wit:
AYES: Councilmen Spierling, Gallagher, Schlegel, Millis and Mayor de Leon
NOES: None
ABSENT: None
the foregoing Resolution was passed and adopted this 22nd day of June, 1976.
