RESOLUTION NO. 1196
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO
GRANDE FINDING AND DETERMINING THAT THE CERTAIN WALKWAY
TO ENCINAS BONITAS PARK IS UNNECESSARY FOR PRESENT STREET
PURPDSES AND ORDERING THE TEMPORARY CLOSURE OF SAID WALKWAY.
BE IT RESOLVED by the City Council af the City of Arroyo Grande as
follows:
1. Pursuant to_ the testimony received at a public hearing held this date,
and notices in accordance with the street vacation procedures set forth In
Dlyisiorr9, Part- 3, Chapter 2 of the Streets and Highways Code (Section 8322;
Resolution No. 1191), this Councl1 finds and determines that the portion of said
walkway to Encinas Bonltas Park hereinafter descrIbed, Is not presently needed
for public street purposes,. although It may be needed in the future for such
purposes.
2. This Council also fln.ds and determInes that the public health, safety
and welfare would be adequately protected and well served by the temporary
closure of said walkway to Encinas Bonltas Park and the same Is hereby ordered
temporarily closed.
3. This Counci I also finds and determines that the public Interest may
require the reopening of said walkway and hereby reserves the authority to do so.
4. That the walkway which the City Council hereby temporarily vacates,
abandons and closes Is described as follows, to wit:
In the City of Arroyo Grande, County of San Luis Obispo,
State of California, that ten foot (10') wide walkway and
public utility easement being a part of Lots 9 and 10 as
delineated on map of Tract No. 398, recorded In-Book 7 of
d Maps at Page 43, records of said County.
On motion of Counci Iman de Leon, seconded by Counci Iman SpJerllng and on
the following roll call vote, to wit:
AYES: Councilmen Spierllng, de Leon, Schlegel, Millis and Mayor Talley
NOES: None
ABSENT: None
the foregoing ResolutIon was-passed and adopted this 13th day of January, 1976.
