RESOLUTION NO. 1194
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO
GRANDE ORDERING THE ABANDONMENT OF A PORTION OF A
ORAINAGE AND PUBLIC UTILITY EASEMENT (GOVERNMENT CODE
SECTION 50430 E1 SEQ.)
WHEREAS, the City Council of the City of Arroyo Grande has elected to
proceed under provisions of Government Code Section 50430, et seq., and in
accordance with the provisions thereof, by resolution, the Arroyo Grande City
Council set the time and place for public hearing of protests for the vacation
of a portIon of a certain drainage and public utility easement at 8:00 P.M.,
December 23, 1975, in the Arroyo Grande City Council Chambers; and
WHEREAS, the Planning Commission of the City of Arroyo Grande did consider
and approve said abandonment; and
WHEREAS, the City Council has found, on the basis of evidence produced at
the public hearing, that the hereinafter described easement is unnecessary for
present or future drainage and public utility purposes;
NOW, THEREFORE, BE IT RESOLVED that the hereinafter described portion of
an Arroyo Grande drainage and public utility easement is vacated and it is so
ordered.
In the City of Arroyo Grande, County of San Luis Obispo,
State of California, the westerly seven and one-half feet
(7i') of that fifty foot (50') wide public utility and
drainage easement which is Garden Street as abandoned in
Book 1649, Page 459 in the Office of the County Recorder
of the County of San Luis Obispo, State of California.
On motion of Councilman de Leon, seconded by Councilman Spierling
and on the following roll call vote, to wit:
AYES: Councilmen Spierling, de Leon, Schlegel, Millis and Mayor Talley
NOES: None
ABSENT: None
the foregoing Resolution was passed and adopted this 23rd day of December, 1975.
