R 1191 ',--:" . , '. ,'"""" "., RESOLUTION NO. 1191 A RESOLUTION OF INTENTION TO TEMPORARILY CLOSE THE WALKWAY TO ENCINAS BONITAS PARK IN THE CITY OF ARROYO GRANDE AND FIXING THE TIME AND PLACE FOR HEARING AS PROVIDED FOR BY STREETS & HIGHWAYS CODE SECTION 8320, ET SEQ. WHEREAS, the City Council of the City of Arroyo Grande desires to temporarily close the walkway from Golden West Place to Encinas Bonitas Park; and WHEREAS, it appears that said walkway is unnecessary for present pedestrian purposes; and WHEREAS, it appears that the temporary closing of said walkway is for the bPst interests of the public. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arroyo Grande that it intends to temporarily close the hereinafter described portion of sidewalk in the City of Arroyo Grande, County of San Luis Obispo, State of Ca 11 forn i a. For that purpose, the City Council will hold a hearing In connection with said intention to temporarily close the hereinafter described walkway, which hearing will be held in the Council Chambers of the City Hall at 214 East Branch I Street, City of Arroyo Grande, County of San Luis Obispo, State of California, on the 13th day of January, 1976, at the hour of 8:00 P.M. At said time and place, those persons Interested in or objecting to the proposed temporary closure of said walkway may appear and be heard thereon. BE IT FURTHER RESOLVED that the City Clerk of the City of Arroyo Grande be, and is herewith directed to cause to be posted along that portion of City walkway hereinafter described, at Intervals not to exceed three hundred feet (300') In distance apart and at least three (3) in number on said walkway" notices of passage of Resolution, which said notices shall be entitled "Kotlce of Intention to Temporarily Close a Portion of the Walkway to Encinas Bonltas Parle, in the City of Arroyo Grande, County of San Luis Obispo, State of California." In addition thereto, the City Clerk Is herewith ordered and directed to cause a copy of said Resolution to be published at least once In the Five Cities Tlmes-Press-Recorder, a weekly newspaper published and circulated In the City of Arroyo Grande, which publication shall be at least ten (10) days prior to the date of said hearing. , BE IT FURTHER RESOLVED that the portion of City sidewalk which the City Council of the City of Arroyo Grande proposes to temporarily vacate, abandon and close is described as follows, to wit: In the City of Arroyo Grande, County of San Luis Obispo, State of California, that ten foot (10') wide walkway and pub Ii c ut Iii ty easement bel ng a part of Lots 9 and 10 as delineated on map of Tract No. 398, recorded In Book 7 of Maps at Page 43, records of said County. BE IT FURTHER RESOLVED that pursuant to the California Streets & Highways Code Section 8330, et seq., that the City Council determines that the public convenience and necessity require the reservation of an easement for the purposes of drainage, water, sewer and utilities and the right to construct, maintain, operate, replace, renew, remove and enlarge said lines, Including access thereto, on that portion of the Encinas Bonltas Park walkway to be temporarily abandoned. On motion of Councilman de Leon, seconded by Councilman Splerling and on the following roll call vote, to wit: AYES: Councilmen Spierling, de Leon, Schlegel, Millis and Mayor Talley NOES: None ABSENT: None 'the foregoing Resolution was passed and adopted this 9th day of December, 1975.
