R 5248 RESOLUTION NO. 5248
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO
GRANDE, CALIFORNIA, RECITING THE FACT OF THE GENERAL
MUNICIPAL ELECTION HELD ON NOVEMBER 8, 2022, DECLARING THE
RESULTS AND SUCH OTHER MATTERS AS PROVIDED BY LAW
WHEREAS, a General Municipal Election was held in the City of Arroyo Grande, California,
on Tuesday, November 8, 2022, as required by law; and
WHEREAS, notice of the election was given in time, form and manner as provided by law;
that voting precincts were properly established; that election officers were appointed and
that in all respects the election was held and conducted and the votes were cast, received
and canvassed and the returns made and declared in time, form and manner as required by
the provisions of the Elections Code of the State of California for the holding of elections in
general law cities; and
WHEREAS, pursuant to Resolution Nos. 5187 and 5188, the San Luis Obispo County
Clerk-Recorder canvassed the returns of the election and has certified the results, which
are attached hereto and made a part herein as "Exhibit A".
NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Arroyo Grande,
California, that:
1. All of the above recitals are true and correct and incorporated herein by reference.
2. The whole number of ballots cast in the city was 9,170.
3. The names of the persons voted for at the election for Mayor are as follows: Caren
Ray Russom, Gaea Powell, and Dale T. Hanson.
4. The names of the persons voted for at the election for District 1 Member of the City
Council are as follows: Kathleen Secrest.
5. The names of the persons voted for at the election for District 4 Member of the City
Council are as follows: Ben Franco, and James Robert Guthrie.
6. The Measure voted upon at the election is as follows:
Measure D-22: To provide funding for general governmental use in Arroyo Grande,
including maintenance and repair of streets, sidewalks, stormwater and drainage
facilities, and for other City programs and facilities, shall an ordinance establishing a
one percent sales tax be adopted, providing approximately $5,600,000 annually until
ended by the City Council and requiring annual reports on revenues and
expenditures, and review and public hearing by the City Council every five years on
its necessity?
7. The whole number of ballots cast and the number of ballots cast for the above-
named offices are listed in "Exhibit A", attached hereto and made a part hereof.
8. The City Council does declare and determine that as a result of the election:

• Caren Ray Russom was elected as Mayor for a full term of two (2) years;
• Kathleen Secrest was elected as District 1 Member of the Council Member for a
full term of four(4) years;
• James Robert Guthrie was elected as District 4 Member of the City Council for
a full term of four (4) years.
• A majority of the voters voting on Measure D-22 relating to the City's authority to
increase the Transaction and Use Tax ("Sales Tax") to fund maintenance and
repair of streets, sidewalks, stormwater and drainage facilities, and for other City
programs and facilities did not vote in favor of it, and that the measure was not
carried, and shall not be deemed adopted or ratified.
9. The City Clerk shall enter into the records of the City of Arroyo Grande a statement
of the results of the election, showing: (1) The total number of ballots cast in the City;
(2) the names of the persons voted for; (3)for what office each person was voted for;
and (4) the total number of votes given to each person, and for and against the
measure.
10. The City Clerk shall immediately make and deliver to each of the persons so elected
a Certificate of Election signed by the City Clerk and authenticated; that the City
Clerk shall administer to each person elected the Oath of Office prescribed in the
Constitution of the State of California and shall have them subscribe to it and file it in
the Office of the City Clerk. Each and all of the persons so elected shall then be
inducted into the respective office to which they have been elected.
11. The City Clerk shall certify to the passage and adoption of this Resolution and enter
it into the book of original resolutions.
On motion by Council Member Barneich, seconded by Council Member George, and on the
following roll call vote, to wit:
AYES: Council Members Storton, Paulding, Barneich, George, and Mayor Ray Russom
NOES: None
ABSENT: None

I, ELAINA CANO, County Clerk-Recorder of the County of San Luis Obispo, do hereby
certify that pursuant to law I did canvass the returns of the votes cast at the above
referenced election in the City of Arroyo Grande on November 8, 2022, and that a
copy of the Statement of Votes Cast to which this certificate is attached, shows the
number of votes cast in said city for each candidate for the office of Mayor, Member
of the City Council, Districts 1 and 4 and that the totals shown for each candidate for
the office of Mayor, Member of the City Council, Districts 1 and 4 in said City in each
