A RESOLUTION OF T1JE CITY COUNCIL OF THE CITY OF ARROYO
GRANDE CONFIRMING THE REPORT OF THE SUPERINTENDENT OF
STREETS AND LEVYING ASSESSMENT FOR THE INSTALLATION OF
CONCRETE CURBS, GUTl'ERS, DRIVEWAY APRONS AND SIDEWALKS.
WHEREAS, pursuant to the provisions of the "Improvement Act of 1911", being
Division 7 of the Streets and Highways Code of the State of California, the
Superintendent of Streets did on the 29th day of August, 1974, notify the owners
or persons in possession of those certain properties within the City of Arroyo
Grande, California, located on Grand Avenue between Barnett Street and the
westerly City Limits, to cause certain installation of concrete curbs, gutters,
driveway aprons and sidewalks to be made adjacent to the hereinabove properties;
that the owners or persons in possession, so notified, failed and neglected to
cause said installation to be made; and that the Superintendent of Streets
proceeded to have said installation done and made at a total cost of Thirteen
Thousand TWo Hundred Forty TWo Dollars and TWenty-Six Cents ($13,242.26); and
WHEREAS, the said Superintendent of Streets, upon the completion of said
installation, filed with this City Council his report upon said installation and
costs thereof, and gave notice to the owners or persons in possession of said
properties hereinabove referred to, in the time, form and manner prescribed by
law, that the hour of 8:00 P.M. on the 27th of May, 1975, was the hour fixed for
hearing upon said report; and evidence having been received thereon;
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ARROYO GRANDE, as follows:
SECTION 1. That all notices have been given as provided by law and
required by the provisions of the "Improvement Act of 1911" and that the report
of the Superintendent of Streets upon the installation be, and it is hereby
confirmed,
SECTION 2. That an assessment in the amount of $13,242,26 representing
the installation made by the Superintendent of Streets against the properties
hereinabove described is hereby made and confirmed; and the Superintendent of
Streets is hereby directed to notify such owners or persons in possession of said
properties of said assessment,
SECTION 3. That if the owners or persons in possession of said properties
fail to pay said assessment within five (5) days from date hereof, as provided by
law, or enter'into an agreement with the City of Arroyo Grande to pay said
assessment over a period of time not to exceed three years, at an annual interest
.... rate of six percent (6%), the Superintendent of Streets shall record a Notice of
Lien in the Office of the County Recorder of the County of San Luis Obispo.
On motion of Councilman Schlegel, seconded by Councilman de Leon and on
the following roll call vote, to wit:

I did, on the 7th day of January 1975, cause. the installation of curb, gutter,
driveway aprons and sidewalks in front of the real property hereinafter
described, Vested Owner P. H. Heersema , and the City
Council of the City of Arroyo Grande, did, on the 27th day of May 1975, by
Resolution No. 1163 assess the cost of such installation upon the real pro-
perty hereinafter described, and the same has not been paid nor any part
thereof, and the said City of Arroyo Grande does hereby claim a lien on said
property in the sum of three thousand five hundred sixty seven and
75/100 Dollars ($ - 3,567.75 ), and the same
shall be a lien upon said real property until the said sum, with interest
at the rate of 6 percent per annum, from the said 13th day of June 1975,
