RESOLUTION NO, ll23
A RESOLUTION OF THE CITY COUNCIL m' THE CITY OF ARROYO
GRANDE, STATE OF CALIFORNIA, DIRECTING TIlE FILING OF
CONDEMNATION ACTION FOR STREET PURPOSES.
WHEREAS, the City Council of the City of Arroyo Grande, State of California,
considers that it would be advantageous to use certain property for street purposes
and it is the intention of the Arroyo Grande City Council to construct and maintain
a city street on the land more particulary described in Exhibit "A", attached
hereto and by this reference made a part hereof,
NOW, THEREFORE, IT IS HEREBY RESOINED:
1. That the City Council of the City of Arroyo Grande has found and
determined that the public interest and necessity require the acquisition,
construction, or completion by said City of a roadway over, above and across
the properties described in Exhibit "A",
2, That the City Council of the City of Arroyo Grande has found and
determined that a fee interest in the properties described ill Exhibit "A" is
necessary,
3, That the law firm of SHIPSEY & SEITZ, INC., who are attorneys for the
said City, be and they are hereby directed to institute and conduct to conclusion
an action in eminent domain for the acquisition of the estates and interests
aforesaid and to take such action as is necessary therein and said law firm of
SHIPSEY & SEITZ, Il~. shall be paid a reasonable fee therefore,
4. That said properties are located in the City of Arroyo Grande, County
of San Luis Obispo, State of California, and are described in Exhibit "A" which
is attached hereto and by this reference made a part hereof.
On motion of Councilman Spierling, seconded by Cmlncilman de Leon and on
the following roll call vote, to wit:
AYES: Councilmen Spierling, de Leon, Schlegel, Millis and Mayor Talley
NOES: None
ABSENT: None
the foregoing Resolution was passed and adopted this 10th day of September, 1974,

I, Ines A, del Campo, City Clerk of the City of Arroyo Grande, County
of San Luis Obispo, State of California, do hereby certify that the foregoing
Resolution No. 1123 is a true, full and correct copy of said Resolution passed
and adopted by the City Council of the City of Arroyo Grande at a regular
meeting of said Council held on the 10th day of September, 1974.
