RESOLUTION NO. 1100
A RESOLUTION OFI1!E CITY COUNCIL OF THE CITY OF ARROYO
GRANDE CONFIRMING THE REPORT OF THE SUPERINTENDENT OF
STREETS AND LEVYING ASSESSMENT FOR THE INSTALLATION OF
CONCRETE S lDEWALKS .
WHEREAS, pursuant to the provisions of the "Improvement Act of 1911", being
Division 7 of the Streets and Highways Code of the State of California, the
Superintendent of Streets did, on the 19th day of October, 1973, notify the owners
or persons in possession of those certain properties within the City of Arroyo
Grande, California, located on: both sides of North Elm Street between Grand
Avenue and Linda Drive; both sides of Linda Drive between North Elm and Ocean View
School; and Brighton Avenue within Tract No, 161, to cause certain installation of
sidewalks to be made adjacent to the hereinabove property; that the owners Dr
persons in possession~ so notified, failed and neglected to cause said installation
to be made; and that the Superintendent of Streets proceeded to have said
installation done and made at a total cost of One Thousand Nine Hundred Seventy-
Four and Eighty Cents ($1,974.80).
WHEREAS, the said Superintendent of Streets, upon the completion of said
installation, filed with this City Council his report upon said installation and
costs thereof, and gave notice to the owners or persons in possession of said
properties hereinabove referred to, in the time, form and manner prescribed by
law, that the hour of 8:00 P.M, on the 11th day of June, 1974, was the hour fixed
for hearing upon said report; and evidence having been received thereon,
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ARROYO GRANDE, as fo llows :
SECTION 1: That all notices have been given as provided by law and
required by the provisions of the "Improvement Act of 1911" and that the report
of the Superintendent of Streets upon the installation be, and it is hereby
confirmed,
SECTION 2: That an assessment in the amount of $1,974,80 representing
the installation made by the Superintendent of Streets against the properties
hereinabove described is hereby made and confirmed; and the Superintendent of
Streets is hereby directed to notify such owners or persons in possession of
said properties of said assessment,
SECTION 3: That if the owners or persons in possession of said properties
fail to pay said assessment within five (5) days from date hereof, as provided by
law, the Superintendent of Streets shall record a Notice of Lien in the Office of
the County Recorder of the County of San Luis Obispo,
On motion of Councilman Schlegel, seconded by Councilman Millis and on
the follor"'ing roll call vote, to wit:
AYES: Councilmen Spierling, de Leon, Schlegel, Millis and Mayor Talley

the foregoing resolution was passed and adopted this 11th day of June, 1974.
