, RESOLUTION NO. 1098
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO
GRANDE MAKING FINDINGS ON PETITION AND WAIVER AND
MAKING APPOINTMENTS REGARDING DESIGNATED DUTIES,
ASSESS~NT DISTRICT NO. 74-1
(STREET IMPROVEMENTS)
WHEREAS, certain property owners have presented to the City Council an
executed Petition requesting the construction of certain public works of
improvement together with appurtenances, said improvements to be financed
through bonds to be issued pursuant to the terms and provisions of the
"Improvement Act of 19l1", being Division 7 of the Streets and Highways Code of
the State of California in assessment district to be known and designated as
follows:
ASSESSMENT DISTRICT NO. 74-1 (STREET IMPROVEMENTS)
WHEREAS, said Petition contains a waiver of the provisions and limitations
of the "Special Assessment Investigation, Limitation and Majority Protest Act of
1931", as provided for in Section 2804 of said Act; and
WHEREAS it has been reported that said Petition and Waiver contains
the signatures of all of the owners of more than sixty percent (60%) in area
of the property to be subject to assessment for said proposed improvement,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1, That the above recitals are all true and correct.
SECTION 2, That the City Council finds that said Petition and Waiver has
been signed by all of the owners of more than sixty percent (60%) in area of the
property to be subject to assessment for the improvement requested in said
Petition, and meets the requirements of Section 2804 of Division 4 of the Streets
and Highways Code of the State of California,
SECTION 3, That said Petition and Waiver shall be filed in the Office of
the City Clerk of said City.
SECTION 4, That said District shall be known and entitled
ASSESSMENT DISTRICT NO, 74-1 (STREET IMPROVEMENTS)
SECTION 5, That said improvements and proceedings shall be financed by
bonds pursuant to the "Improvement Act of 1911", being Division 7 of the Streets
and Highways Code with said proceedings pursuant to either the "Municipal
Improvement Act of 1913", being Division 12 of the Streets and Highways Code or
the "Improvement Act of 19l1", being Division 7 of said Code,
On motion of Councilman Schlegel, seconded by Councilman Spier ling and on
the following roll call vote, to wit:
AYES: Councilmen Spierling, de Leon, Schlegel, Millis and Mayor Talley
NOES: None

the foregoing resolution was passed and adopted this 28th day of May, 1974,
