R 5303 RESOLUTION NO. 5303 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE APPROVING THE 2022 URBAN WATER MANAGEMENT PLAN AND THE WATER SHORTAGE CONTINGENCY PLAN AND AUTHORIZING THEIR SUBMITTAL TO THE DEPARTMENT OF WATER RESOURCES WHEREAS, The California Urban Water Management Planning Act, (Wat. Code §10610, et seq. (UWMPA)), mandates that every urban supplier of water providing water for municipal purposes to more than 3,000 customers or supplying more than 3,000-acre feet of water annually, prepare and adopt, in accordance with prescribed requirements, an Urban Water Management Plan (UWMP) and a Water Shortage Contingency Plan (WSCP); and WHEREAS, the UWMPA specifies the requirements and procedures for adopting such WSCPs; and WHEREAS, pursuant to recent amendments to the UWMPA, urban water suppliers are required to adopt and electronically submit their UWMPs and WSCPs to the California Department of Water Resources; and WHEREAS, the City meets the definition of an urban water supplier for purposes of the UWMPA and is required to prepare and adopt an UWMP and a WSCP; and WHEREAS, the City has prepared an UWMP and a WSCP in accordance with the UWMPA, and in accordance with applicable legal requirements, has undertaken certain coordination, notice, public involvement, public comment, and other procedures in relation to its UWMP and WSCP; and WHEREAS, §10652 of the California Water Code provides that the California Environmental Quality Act (Division 13 (commencing with §21000) of the Public Resources Code) (CEQA) does not apply to the preparation and adoption of a UWMP pr WSCP pursuant to California Water Code §10632. WHEREAS, staff recommends approving the UWMP and WSCP and authorizing their submittal to the Department of Water Resources; and NOW THEREFORE BE IT RESOLVED, the City Council of the City of Arroyo Grande hereby approves and adopts the 2022 Urban Water Management Plan and Water Shortage Contingency Plan as amended by changes incorporated by the City Council as a result of input received (if any) at the public hearing and authorizes submittal of the UWMP and WSCP to the Department of Water Resources.
