RESOLUTION NO. 1071
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO
GRANDE, STATE OF CALIFORNIA, DIRECTING THE FILING OF
CONDEMNATION ACTION FOR STREET PURPOSES,
WHEREAS, the City Council of the City of Arroyo Grande, State of
California, considers that it would be advantageous to use certain property
for street purposes,
NOW, THEREFORE, IT IS HEREBY RESOLVED:
1, The City Council of the City of Arroyo Grande has found and determined
that the public interest and necessity require the acquisition, construction or
completion by said City of a roadway over, above and across the hereinafter
described property,
2. The City Council of the City of Arroyo Grande has found and
determined that a fee simple interest in the hereinafter described property
is necessary.
3, That the property hereinafter described is necessary for street
purposes and hereby directs the City Attorney to prepare, commence, and
prosecute proceedings in eminent domain to acquire said property for the
purpose of public use and street purposes,
4, Ihat said property is located in the City of Arroyo Grande, County of
San Luis Obispo, State of California, and is described as follows:
That portion of Lot 28 of Wood's Addition to the Town of Arroyo
Grande, recorded in Book B, Page 11 of Maps in the Office of the
County Recorder of the County of San Luis Obispo, State of
California, lying Soutl~rly of the Northerly Plan Line as shown
on a map entitled "Amended Plan Line of Cherry Avenue" between
Traffic Way and Railroad Avenue filed in Book I, Page 22 of Plan
Line Maps filed in the Office of the County Recorder of said
County and included within the lines of the land described in
Deed to A. Wayne Luke, et ux by joint tenancy deed dated August 9,
1948 and recorded August 14, 1948, in Book 484, Page 379 of
Official Records of said County.
On motion of Councilman de Leon, seconded by Councilman Talley and on the
following roll call vote, to wit:
AYES: Councilmen Talley, Millis, Wood, de Leon and Mayor Schlegel
NOES: None
ABSENT: None
