existence of a local emergency by the Acting Director of Emergency
Services/City Manager.

SUBJECT: CONSIDERATION OF RESOLUTION CONFIRMING THE
PROCLAMATION OF THE EXISTENCE OF A LOCAL EMERGENCY

RECOMMENDATION:
It is recommended the City Council adopt a Resolution confirming the existence of a
local emergency as declared by the Acting Director of Emergency Services/City
Manager.
FINANCIAL IMPACT:
There is no cost impact from this action.
BACKGROUND:
The City of Arroyo Grande has experienced an overwhelming amount of rain over the
past week. The large amount of unusually heavy rains has resulted in heavy runoff
which has impacted or is likely to significantly impact property within the City. In
particular, the following conditions have been experienced:
• The City's drainage basins located at Ash and Elm Streets have reached
near maximum capacity. During extreme rain Retention Pond N . 1, when
exceeding capacity, will overflow into Retention Pond #2. When Retention
Pond No. 2 exceeds capacity, the water will flow onto Farroll Avenue via
the storm drain. To keep the water from flowing onto Farroll Avenue, the
storm waters are diverted to Ikeda and Volunteer Sports fields.
• The water diversion to the sports fields severely damaged, if not destroyed
the turf at the Soto Complex sports fields.
• Persistent heavy rainfalls have caused localized area street flooding,
slope failures, and land subsidence within the City.

• With additional rains forecasted, heavy ground saturation and partially
completed public and private drainage improvement projects in the South
Eastern portion of the City, there is the potential for significant wide spread
additional flooding.
• Additional flooding has the potential to cause a break in the levy located
on the Arroyo Grande Creek, immediately west of the City boundaries
creating a potential threat to the health, safety and welfare of the residents
of the City of Arroyo Grande and the County of San Luis Obispo.
• The City is hosting a regional temporary 24 hour emergency housing
shelter located at Arroyo Grande High School for those residents that
have been displaced from their homes in neighboring jurisdictions.
As Acting Director of Emergency Services, a determination was made that a local
emergency situation exists and a proclamation was issued on December 22, 2010
declaring the existence of a local emergency effective December 19, 2010.
These and other related conditions are likely to be beyond the capacity of the services,
personal, equipment and the facilities of the City of Arroyo Grande including but not
limited to:
• Law Enforcement
• Fire Department
• Maintenance Services
• Disruption of essential City services.
ANALYSIS OF ISSUES:
Pursuant to Arroyo Grande Municipal Code Chapter 8.12, the Proclamation declaring
the local emergency must be ratified by the City Council within seven days of its
issuance. Once approved, staff will forward the Resolution to the County Office of
Emergency Services and to the State of California. If approved by the County and State
governments, the City of Arroyo Grande may be able to receive financial support for
expenses incurred in response to the emergency.
The City has incurred, and will continue to incur, significant overtime costs for public
safety and maintenance division staff as a result of activities associated with the storms.
Materials and equipment have been used over and above normal operational levels.
The City of Arroyo Grande has minimal staffing to accomplish regular activities.
Therefore, the City may have to rely upon the assistance of outside agencies to provide
support and services.

Adoption of this Resolution allows local resources to respond even more promptly than
they already have been by streamlining the approval process necessary to obtain
additional assistance and resources, and may provide the City with the opportunity for
potential cost recovery for expenses incurred in this emergency.

The following alternatives are provided for the Council's consideration:
1 . Adopt a Resolution confirming the existence of a local emergency;
2. Do not adopt a Resolution confirming the existence of a local emergency
and continue to utilize existing City resources to respond to emergencies;
or
3. Provide staff direction.
ENVIRONMENTAL REVIEW:
No environmental review is required for this item.
PUBLIC NOTIFICATION AND COMMENTS:
The Agenda was posted in front of City Hall and on the City's website on Wednesday,
December 22, 2010, and the news media was notified in compliance with the Brown Act
for emergency meetings.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ARROYO GRANDE, CALIFORNIA,IA, CONFIRMING THE
ACTING DIRECTOR OF EMERGENCY SERVICES/CITY
MANAGERS' PROCLAMATION OF EXISTENCE OF A
LOCAL EMERGENCY
WHEREAS, Section 8.12.060 of the Arroyo Grande Municipal Code empowers
the Director of Emergency Services/City Manager ("Director") of the City of
Arroyo Grande to proclaim the existence or threatened existence of a local
emergency when the City is affected or likely to be affected by a public calamity
and the Disaster Council/City Council ("Council") is not is session and requires
that the Council take action to ratify the Proclamation within seven days
thereafter; and
WHEREAS,EAS, such Proclamation entitles the Director, and the emergency
organization of this City, to all the powers, functions, and duties prescribed by
State law, ordinances, and resolutions of this jurisdiction and by the Operational
Area Emergency Plan during the existence of said Local Emergency; and
WHEREAS,EAS, the Director determined that on December 19, 2010 conditions of
extreme peril to the safety of persons and property arose as a result of
unusually heavy rains, resulting in heavy runoff which threatened property within
the City of Arroyo Grande, and these conditions necessitated the proclamation
of the existence of a local emergency within the City of Arroyo Grande, at which
time the Council was not in session and could not be called into session; and
WHEREAS, the Council acknowledges conditions existing within the County of
San Luis Obispo and does hereby find that the conditions of extreme peril did
warrant and necessitate the Proclamation of the existence of a local emergency
in the City of Arroyo Grande; and
WHEREAS,EAS, on December 22, 2010, the Director issued a Proclamation
declaring the existence of a local emergency, as set forth in Exhibit A, a copy of
which is attached hereto and incorporated herein by this reference.
NOW, THEREFORE,E, BE IT RESOLVED by the City Council of the City of Arroyo
Grande that the Proclamation of Existence of a Local Emergency, as issued by
the Acting Director of Emergency Services, is hereby ratified and confirmed.
BE IT FURTHER RESOLVED EC that the local emergency shall be deemed to
continue to exist until its termination is proclaimed by the Council of the City of
Arroyo Grande.

PROCLAMATION OF EXISTENCE OF A LOCAL EMERGENCY
BY THE ACTING DIRECTOR OF EMERGENCY SERVICES OF
THE CITY OF ARROYO GRANDE
WHEREAS,EAS, Section 8.12.060 of the Arroyo Grande Municipal Code empowers the
Director of Emergency Services/City Manager "Director" of the City of Arroyo Grande
to proclaim the existence of a local emergency when the City is affected or likely to be
affected by a public calamity and the Disaster Council/City Council "Council" is not is
session; and
WHEREAS, the Acting City Manager, as Acting Director of Emergency Services of the
City of Arroyo Grande, finds that on December 19, 2010 conditions of extreme a peril to
the safety of persons and property arose as a result of unusually heavy rains, resulting
in heavy runoff which threatened property within the City of Arroyo Grande, and these
conditions necessitated the proclamation of the existence of a local emergency within
the City of Arroyo Grande; and
WHEREAS, the City of Arroyo Grande acknowledges conditions existing within the
County of San Luis Obispo and supports its proclamation of a local emergency; and
WHEREAS, these conditions warrant and necessitate that the City of Arroyo Grande
proclaim the existence of a local emergency, and the Council is not is session and
cannot immediately be called into session; and
WHEREAS, this Proclamation of Local Emergency will be ratified by the Council within
seven days of being issued.
NOW, THEREFORE,I E, IT IS HEREBY PROCLAIMED IED by the Acting Director of
Emergency Services of the City of Arroyo Grande, that a local emergency exists
throughout the City, and that said emergency shall be deemed to continue to exist until
its termination is proclaimed by the Council; and
IT IS FURTHER PROCLAIMED AND ORDERED ED that during the existence of said local
emergency the powers, functions, and duties of the emergency organization of this City
shall be those prescribed by State law, ordinances, and resolutions of the City, and by
the City of Arroyo Grande Emergency Plan; and
IT IS FURTHER PROCLAIMED AND ORDERED ED that a copy of this Proclamation of
Local Emergency be forwarded to the San Luis Obispo County Office of Emergency
Services and to the State Director of the Governor's Office of Emergency Services with
a request that;
1. The State Director find the Proclamation of Local Emergency acceptable in
accordance with provisions of the Natural Disaster Assistance Act; and that
2. The State Direct•r forward this Proclamation, and request for a State
Proclam- len an. °residential Declaration of Emergency, to the Governor of
Califor a or co, deration and action.
