RESOLUTION OF THE CITY COUNCIL OF THE CITY OF I
ARROYO GRANDE CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS AND LEVYING ASSESSMENT
FOR THE INSTALLATION OF CONCRETE CURB, GUTTER,
DRIVEWAY APRONS AND SIDEWALKS.
WHEREAS, pursuant to the provisions of the "Improvement Act of 1911", being
Divi sion 7 of t.lle Streets Ind Highways Cede ,~f U"" Stat.., of California, the
Superintendent of Street.s did on t.he 29th day of O<:tooel:, 1.969, notify the .:>wners
or persons in possession "f those certa!.n propert.ies within the City of AtToyo
Grande, California, located at: on the sout.h sid., of Grand Ave. between South
Alpine Street and t.he 101 Highway on-:tamp in frO\01lI: of the Gulf Service station
at 319 Grand Ave., to cause certain installation of concret.e curb, gutter, d.riveb
way aprons and sidewalks to he mad" adjacent to the hercdnabove propert~>; that
the owners or persons in possessi"n, so notified, fai1.ed and neglected t.o cause
said installation t.o be made; and that the Superintendlmt: of Streets proceeded
to have said installation dent., and made at a total cost. of One Thousand One Dollar
~nd Forty Seven Cents, ($1.,001.47), and
WHEREAS, the sai..d Superintendent of Streets, "po:!. the completion of said
iristallation, filed with ,this City Cour>.cil his report upon said iustallatio!\ and
costs thereof, and gave notice to the o~.ers or persons in possessio~ of said
properties hereinabove referred to, in the time, form and manner p~'escribed by
law, that the hour of 8:00 P.M. on t.he .24th day of November, 1970, was the hour
f.ixed for hearing upon said report; and evidence having been received thereon,
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF TH.E CITY OF
ARROYO GRANDE, as follows:
SECTION 1. That all notices have been given as provided by law and required
by the provisi.ons of the "Improvement Act of 1911" and that the report of the
Superintendent of Streets upon the installation be, and it is herehy confirmed.
SECTION 2. That an assessment in the amount of $1,001.47 representing the
installation made by the Superintendent of Streets against the properties here-
inabove described is hereby made and confirmed; and the Superintendent of Streets
is hereby directed to notify such owners or persons in possession of said pro-
perties of said assessment.
SECTION 3. That if the owners or persons in possession of said properties
fail to pay said assessment within five (5) days from date hereof, as provided
by law, the Superintendent of Streets shall record a Notice of Lien in the Office
of the County Recorder of the County of San Luis Obispo.
On motion of Councilman Talley, seconded by Councilman Wood
and on the following roll call vote, to wit:
