R 0808 ~ --' RESOLUTION NO. 808 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE CALLING A PUBLIC HEARING TO DETERMINE WHETHER PUBLIC NECES- SITY, HEALTH, SAFETY, OR WELFARE REQUIRES THE FORMATION OF AN UNDERGROUND UTILITY DISTRICT ON BRANCH STREET. BE IT RESOLVED by the Council of the City of Arroyo Grande as follows: WHEREAS, Ordinance No. 10 C.S. and amended by 19 C.S. establishes a procedure for the creation of underground utility districts and requires as the initial step in such procedure the holding of a public hearing to ascertain whether public necessity, health, safety, or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service in any such dis- trict; and WHEREAS, it has been recommended that such an underground utility district, hereinafter called District, be formed within that area, the boundaries which are described as follows: On the west by the easterly right-of-way line of California State Highway 101; on the north by a line located 150 feet northerly and parallel to the center line of Branch Street; on the east by westerly right-of-way line at the old P.C.R.R. right-of-way; on the south by a line located 150 feet south and parallel to the center line of Branch Street. NOW, THEREFORE, Be it Resolved as follows: 1. NOTICE IS HEREBY GIVEN that a public hearing will be held by the Council of the City of Arroyo Grande on November 26th, 1968, at the hour of 8:00 P.M. in the Cou,:,cil Chambers of the City Hall, Arroyo Grande,Cali- fornia, to ascertain whether the public necessity, health, safety or wel- fare requires the removal of poles, overhead wires and as,,"ociatedover- head structures and the underground installation of wires and facilities for supplying electric, communication, or similar associated service in the District hereinabove described. 2. At such hearing all persons interested shall be given an oppor- tunity to be heard. Said hearing may be continued from time to time as may be determined by the City Council. 3. The City Clerk shall notify all affected property owners as shown on the last equalized assessment roll and utilities concerned of the time and place of such hearing by mailing a copy of this resolution to such property owners and utilities concerned at least thirty (30) days prior to the date thereof. 4. The area proposed to be included in the District is shown upon that certain map entitled "Underground Utility District No. 1", dated October 14, 1968, which is on file in the office of the City Clerk of the City of Arroyo Grande. On motion of Councilman Levine, seconded by Councilwoman Thompson, and on the following roll call vote, to wit: AYES: Councilwoman Thompson, Councilmen Levine, Schlegel, Smith and Mayor Wood.
