RESOLUTION NO. 765
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARROYO GRANDE CONFIRMING THE REPORT OF THE SUPER-
INTENDENT OF STREETS AND LEVYING ASSESSMENT FOR
THE INSTALLATION OF CONCRETE CURB, GUTTER AND
DRIVEWAY APRONS.
WHEREAS, pursuant to the provisions of the "Improvement Act of 1911",
being Division 7 of the Streets and Highways Code of the State of Calif-
ornia, the Superintendent of Streets did on the 4th day of May, 1967,
notify the owners or persons in possession of those certain properties
within the City of Arroyo Grande, California, located at: those portions
of property on the west side of South Alpine Street between Grand Avenue
and Dodson Way and on the east side of South Alpine Street between Grand
Avenue and Eman Court and on the east side of South Alpine Street between
Eman Court and Newman Drive in which no concrete curbs or gutters have
been constructed theretofore, to cause certain installation of concrete
curb, gutter and driveway aprons to be made adjacent to the hereinabove
properties; that the owners or persons in possession, so notified failed
and neglected to cause said installation to be made;.and that the Superin-
tendent of Streets proceeded to have said installation done and made at a
total cost of Three Hundred Sixty Five Dol]ars and Forty Eight Cents,
($365.48) and
WHEREAS, the said Superintendent of Streets upon the completion of
said installation, filed with this City Council his report upon said
installation and costs thereof, and gave notice to the owners or persons
in possession of said properties hereinabove referred to, in the time,
form and manner prescribed by law, that the hour of 8:00 P.M. on the 26th
day of September, 1967, was the hour fixed for hearing upon said report;
and evidence having been received thereon,
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ARROYO GRANDE, as follows:
SECTION 1. That all notices have been given as provided by law and
required by the Provisions of the "Improvement Act of 1911" and that the
report of the Superintendent of Streets upon the installation be, and it
is hereby confirmed.
SECTION 2. That an assessment in the amount of $365.48 representing
the installation made by the Superintendent of Streets against the proper-
ties hereinabove described is hereby made and confirmed; and the Super-
intendent of Streets is hereby directed to notify such owners or persons
in possession of said properties of said assessment.
SECTION 3. That if the owners or persons in possession of said
properties fail to pay said assessment within five (5) days from date
hereof, as provided by law, the Superintendent of Streets shall record
a Notice of Lien in the Office of the County Recorder of the County of
San Luis Obispo.
On motion of Councilman Burt , seconded by Councilman
Levine and on the following roll call vote, to wit:
AYES: Councilwoman Thompson, Councilmen Levine, Schlegel,
Burt and Mayor Wood
