THE INSTALLATION QF CONCRE1TE CURft,'.GUTTER AND
DRIVEWAY APRONS.
WHEREAS, pursuant to the provisions of the "Improvement Act of 1911",
being Division 7 of the Streets and Highways Code of the state of Calif-
ornia, the Superintendent of Streets did on the 25th day of March, 1966,
notify the owners or persons in possession of those certain properties
within the City of Arroyo Grande, California, located at: certain areas
on the north and south sides of Grand Avenue between Elm Street and Hal-
cyon Road to cause certain installation of concrete curb, gutter and
driveway aprons to be made adjacent to the hereinabove propertiesr that
the owners or persons in possession, so notified failed and neglected
to cause said installation to be mader and that the Superintendent of
Streets proceeded to have said installation done and made at a total
cost of Two Thousand Three Hundred Five Dollars and Twenty-Three Cents
($2,305.23) and
WHEREAS, the said Superintendent of Streets upon the completion of
said installation, filed with this City Council his report upon said
installation and costs thereof, and gave notice to the owners or persons
in possession of said properties hereinabove referred to, in the time,
form and manner prescribed by law, that the hour of 8:00 P.M. on the 23rd
day of August, 1966, was the hour fixed for hearing upon said reportr
and evidence having been received thereon,
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ARROYO GRANDE, as follows:
SECTION 1. That all notices have been given as provided by law and
required by the Provisions of the "Improvement Act of 1911" and that the
report of the Superintendent of Streets upon the installation be, and
it is hereby confirmed.
SECTION 2. That an assessment in the amount of $2,305.23 representing
the installation made by the Superintendent of Streets against the pro-
perties hereinabove described is hereby made and confirmedr and the
Superintendent of Streets is hereby directed to notify such owners or
persons in possession of said properties of said assessment.
SECTION 3. That if the owners or persons in possession of said
properties fail to pay said assessment within five (5) days from date
hereof, as provided by law, the Superintendent of Streets shall record
a Notice of Lien in the Office of the County Recorder of the County of
San Luis Obispo.
On motion of Councilmnn Schleqel , seconded by
Councilman Burt and on the following roll call vote, to-wit:
AYES: Councilwoman Thompso'1, CO'lncilmen Levine, Schlegel, Burt
and Mayor 'flood,
NOES: None,
ABSENT: None,
the foregoing Resolution was adopted this 24th day of August, 1966.
