AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE APPROVING AN AMENDMENT TO THE MUNICIPAL CODE OF THE CITY OF ARROYO GRANDE AS PROVIDED BY CHAPTER 4 ZONING, ARTICLE 32 OF SAID CODE, REZONING APPROXIMATELY 11.25 ACRES OF LAND LOCATED ON THE NORTHERLY SIDE OF U. S. HIGH~ 101, AND LOCATED APPROX- IMATELY2500 FEET DUE EAST OF OAK PARK BOULEVARD AND U. S. HIGH- WAY 101 FROM "A" AGRICULTURAL DISTRICT TO "P-D" COMMERCIAL PLAN- NED DEVELOPMENT DISTRICT, PER CONDITIONS OUTLINED IN THIS ORDIN- ANCE. THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE DOES ORDAIN AS FOLLOWS: SECT! ON I. Rezone the parcel of land, approximately 11.25 acres In size, located north of U. S. Highway 101 approximately 2500 feet due east of the inter- section of Oak Park Boulevard and U. S. Highway 101 (more particularly described in 'Zoning Unit Map attached hereto and incorporated herein by reference), from the "A" Agricultural District to "P-D" Commercial Planned Development District, pursuant to the Development Requirements outllnedin this Ordinance. SECT! ON 2. That the owners of said property shall participate in a joint master plan of the above described property with the owners of the Rancho Grande Project, facilitating a comprehensive land use master plan, including a circula- tion element, ~~idplan to be approved by City Ordinance prior to the approval and issuance of any bui Iding ..permit. SECTION 3. It is further a condition of this Ordinance that should the owners of this subject property consisting of 11.25 acres wish to develop their property, the approval procedure shall not be dependent upon Rancho Grande first developing a plan,rather each party shall expose their individual conceptual plans incorporating a compatible la.nd use, comparable themes in architecture and a circulation element that will jointly facilitate accessibility for the entire commercial proj~ct area. SECTION 4, Notwithstanding the provisions of Section 2 hereof, in the event that one of the property owners refuses or fails to participate in. prepara- r tion of said-joint Master Plan or if they cannot agree upon a joint Master Plan for any reason, theC i ty Counc i1 can by City Ord i nance cons i der and approve, modify or disapprove the proposed development plan presented by one of said pro- perty owners. SECTION 5. Any proposal that wi 11 change a port ion of the land use or the conceptua'l master plan shall be deemed a change in the approval of said Ordin- ance. Sa i d changes will requi re recons i derat i on of the overa 11 project or por- tions thereof through the full 20ne Change procedures with the publ ic retaining all of their rights regarding said zone changes. SECT! ON 6. Development Requirements: I. That ~ six inch high concrete curb be installed between the paved and landscaped areas. 2. That all ducts, meters, air conditioning equipment and all other mechanical equipment serving improvements on said property be reason- ably screened from public view with materials architecturally compat- ible with the main structure (it is especially important that gas and electric meters be completely screened from public view). 3. That street numbers of all buildings be posted so as to be easily read from the street at all times, day and night. 4. Tha tall lighting be constructed in such a manner that glare is directed away from surrounding properties and public rights of way. ::5. That all mechanical equipment be constructed in such a manner that noise emanating from it will not be perceptible at or beyond the property line of the subject property in a normal environment for that zoning district. 6. That if signing is desired for the development, an overall comprehensive signing program be submitted to the City for review under separate appli- cation. l ~._- _._____~__J.___._.__._ _____~ . ( ( .' ORDINANCE NO. 192 C.S. PAGE TWO , 7. That all trees used in private landscape areas shall be a minimum of IS gallons in size and all shrubs a minimum of S gallons in size. 8. That all trash and refuse be contained completely within an enclosed area which Is architecturally compatible with the main structure. 'tit 9. That all parking spaces be striped. That all parking spaces be pro- vided with wheel stops unless they are fronted by concrete curbs, in which case sufficient areas shall be provided beyond the ends of all parking spaces to accommodate the overhang of automobiles. 10. Special frontage road section shall be a minimum of S6 feet of right of way, with bikeway system provided on the southerly side. Sidewalks are required for the frontage road. II. That frontage road Improvements for either of the subject properties from Brisco Road to the westerly property line of the Catholic Cemetery shall be the responsibility of the property owner as each phase of development is approved. 12. If commercial driveways are provided on the westerly side of the west parcel and the frontage road from Oak Park Road is not yet completed, the property owner shall be responsible for a minimum of two lanes to Oak Park Road. SECTION 7. This Ordinance shall be In full force and effect thirty (30) days after its passage, and within fifteen (IS) days after its passage, it shalJ be published once, together with the names of the Council Members voting thereon, in the FI VE C IT I ES TIMES PRESS RECORDER. On the motion of Council Member Pope, seconded by Council Member Smith and on the following roll call vote, to wit: AYES: Council Members Pope, Smith and Mayor Millis. NOES: 'None.
