It shall be the duty of the Chief Electrical Inspector to enforce the provisions of this Code. Be shall upon application grant permits for the installation or alteration of electrical wiring, devices, appliances, apparatus and equipment, and shall make inspections of all new electrical installations and reinspection of all electrical installations, all as provided in this Code. Be shall keep complete records of all permits issued, inspections and reinspectioDl made and other official work performed in accordance with the provisions of this Code. He shall also keep a file of listed electrical wiring, devices, appliaaces. apparatus and equipment issued by or ,for Underwriters I Laboratories, Inc., which file shall be available for public information during office hours. The ,Chief Electrical Inspector shall have a right during reasonable hours to enter any building in the discharge of his official duties, or for the purpose of making any inspection, reinspection or test of the installatioD of electrical wiring. devices, appliances, apparatus and equipment contaiaed therein, except that the Inspector is not empowered to enter any dwelling. while the s_ is occupiedaa a dwelling, without the consent of the occupant thereof. The Chief .Electrical Inspector shall have the authority to cut or disconnect any wire in case of emergency where aecessary for safety to life or property, or where. such wire may interfere with the work of the fire department. The Chief Electrical Inspector may delegate any of his pOllers or duties to any of his assistants. It shall be unlawful for the Chief Electrical Inspector or any of his assistants to eogage in business. within the area under his jurisdiction. of the sale, installation or maintenance of electrical wiring. devices, app.liaaces, apparatus or equipaient, either directly or indirectly. and they shall have DO financial interest in any concern engaged in such business while holding such office as herein provided for. (3/75) I I . "~ ~J . Section 8-3.03 PERMITS A. Genera 1. No electrical wiring, devices, appliances, apparatus, or equipment shall be installed within or on any building, structure or premises, nor shall any alteration or addition be made in any such existing electrical wiring, devices, appliances, apparatus or equipment without first securing a permit therefor from the Chief Electrical Inspector, except as stated in the following paragraphs 1, 2, 3 and 4. 1. No permit shall be required for the replacement of lamps or the connection of portable appliances to suitable receptacles which have been permanently installed. 2. No permit shall be required for the installation, alteration or repair of electrical wiring, devices, appliances, apparatus or equipment for the operation of signals or the transmission of intelligence (not including the control of lighting or appliance circuits) where such electrical wiring, device, appliances, apparatus or equipment operate at a voltage not exceeding 25 volts between conductors and do not include generating or transforming equipment capable of supplying more than 50 watts of energy. 3. No permit shall be required for the installation, alteration or repair of electrical wiring, devices, appliances, apparatus or equipment installed by or for any public utility, municipal corporation or public district for the use of such utility, municipal corporation or public district in the generation, transmission, distribution or metering of electrical energy or in the operation of signals or the transmission of intelligence in the exercise of its function as a serving utility. 4. No permit shall be required for the installation of temporary wiring for testing electrical apparatus or equipment. Application for such permit, describing the work to be done, shall be made in writing to the Chief Electrical Inspector by the person, firm or corporation installing the work. The application shall be accompanied by such plans, specifications and schedules as may be necessary to determine whether the installation as described will be in conformity with the requirements of this Code. If it shall be found that the installation as described will in general conform with the requirements of this Code, and if the applicant has complied with all provisions of this Code, a permit for such installation shall be issued; provided, however, that the issuance of the permit shall not be taken as permission to violate any of the requirements of this Code. The permit when issued shall be for such installation as is described in the application and no deviation shall be made from the installation so described without the prior written approval of the Chief Electrical Inspector. B. Maintenance Electricians. In lieu of an individual permit for each installation or alteration, an annual permit may, upon application therefor, be issued to any person, firm or corporation regularly employing one or more electricians for the installation and maintenance of electrical wiring, devices, appliances, apparatus or equipment on premises owned or occupied by the applicant for the permit. The application for such annual permit shall be made in writing to the Chief Electrical Inspector and shall contain a description of the premises within which work is to be done under the permit. Within not more than fifteen (15) days following the end of each calendar month, the person, firm or corpora- tion to which an annual permit is issued shall transmit to the Chief Electrical Inspector a report of all electrical work which has been done under the annual permit during the preceding month. C. Special Residential Owner's Permit. The Chief Electrical Inspector may issue to an individual a special residential owner's permit authorizing said individual to install, alter, change or repair any electrical wiring, device, appliances, apparatus or equipment in, on or about a dwelling of which said individual is owner and in which he resides or intends to reside, but not else- where; provided, that no electrical work authorized under any such special residential owner's permit shall be done, nor shall the owner holding any such permit allow any such work to be done, except personally by the owner to whom the permit is issued, or by a member of his immediate family; and if this or any other provisions hereof shall be violated by the holder of such special residen- tial owner's permit, such permit shall be subject to immediate cancellation by the Chief Electrical Inspector, and the holder thereof shall be liable to the penalty hereinafter provided for violation of this Code. The requirements of this Code are hereby specifically declared to govern and control the installation, alteration or repair of any electrical wiring, devices, appliances, apparatus or equipment in any building or structures owned or controlled by any private, public or quasi-public or agency except as to wuch electrical wiring as is specifically exempt under this section. E. No permit shall be issued to any person, firm or corporation to do or cau.e to be done any work regulated by this code except to a penon, firm or corporation holding a valid State Electrical Contractor'. In all such cases, a permit must be obtained as soon ,as it is practical to do so, and if there be an unreasonable delay in obtaining such a permit a double fee as herein provided shall be charged. ORD. 118 C.S. - 3 - ~ ---- ---- . " . ~- /.J . A fee of $10.00 shall be paid for each annual Maintenance Electrician's permit at the time when such permit is issued. Fees for all new work installed under such a permit since the date of the last previous inspection shall be paid, according to the above schedule, at the time when such work is inspected; these fees shall be in addition to the fee paid at the time when the annual permit is issued. Section 8-3.05 INSPECTION AND CERTIFICATES Upon completion of the work which has been authorized by issuance of any permit, except an annual permit, it shall be the duty of the person, firm or corporation installing the same to notify the Chief Electrical Inspector, who shall inspect the installation within 48 hours, exclusive of Saturdays, Sundays and Holidays, of the time such notice is received by the Chief Electrical Inspector or as soon thereafter as practicable. Where the Chief Electrical Inspector finds the installation to be in conformity with the provisions of this Code, he shall issue and deliver to the person, firm or corporation making the installation a certificate of approval, authorizing the use of the installation and connection to the source of supply, and shall immediately send written notice of such authorization to the electri- cal utility furnishing the electric service. If upon inspection the installation is not found to be fully in conformity with the provisions of this Code, the Chief Electrical Inspector shall at once notify in writing the person, firm or corporation making the installation, which said notice shall speciry the defects which have been found to exist. All defects shall be corrected within ten (10) days after inspection and notification, or within other reasonable time as permitted by the Chief Electrical Inspector. When a certificate of approval is issued authorizing the connection and use of temporary work, such certificate shall be issued to expire at a time to be stated therein and shall be revocable by the Chief Electrical Inspector for cause. A preliminary certificate of approval may be issued authorizing the connection and use of certain specific portions of an incompleted installation; such certificate shall be revocable at the discretion of the Chief Electrical Inspector. When any part of a wiring installation is to be hidden from view by the permanent placement of parts of the building, the person, firm or corporation installing the wiring shall notify the Chief Electrical Inspector and such part of the wiring installation shall not be concealed until it has been inspected and approved by the Chief Electrical Inspector; provided that on large installa- tions, where the concealment of parts of the wiring proceeds continuous ly, the person, firm or corporation installing the wiring shall give the Chief Electrical Inspector due notice and inspections shall be made periodically during the progress of the work. The Chief Electrical Inspector shall have the power to remove, or require the removal of, any obstruction that prevents proper inspection of any electrical wiring, devices, appliances, apparatus or equipment. At least once in each calendar month the Chief Electrical Inspector shall visit all premises where work has been done under annual permits and shall inspect all electrical wiring, devices, appliances, apparatus and equipment installed under such a permit since the date of his last previous inspection, and shall issue a certificate of approval for such work as is found to be in conformity with the provisions of this Code after the fee required by Section 8-3.04 has been paid. Section 8-3.06 CONNECTION TO INSTALLATION Except where work is done under a Maintenance Electrician's permit, it shall be unlawful for any person, firm or corporation to make connection from a source of electrical energy or to supply electrical service to any electrical wiring, devices, appliances, apparatus or equipment for the installation of which a permit is required, unless such person, firm or corporation shall have obtained satisfactory evidence that such electrical wiring, devices, appliances, apparatus or equipment are in all respects in conformity with all applicable legal provisions. " ~ ~ It shall be unlawful for any person, firm or corporation to make connections from a source of electrical energy or to supply electrical service to any electri- cal wiring, devices, appliances, apparatus or equipment which has been disconnected or ordered to be disconnected by the Chief Electrical Inspector or the use of which has been ordered by the Chief Electrical Inspector to be discontinued until a certificate of approval has been issued by him authorizing the reconnectionand use of such electrical wiring, devices, appliances, apparatus or equipment. The Chief Electrical Inspector shall then innnediately notify the serving utility in writing of the issuance of such order to discontinue use. Section 8-3.07 GENERAL REOUTREMENTS A. Standards for Installation and Materials. All installations shall be in conformity with the provisions of this Code and with approved standards for safety to life and property. B. Residential. The requirements of the National Electrical Code shall apply to all residential installations. C. Commercial and Industrial. All commercial and industrial installations shall comply with the requirements of the National Electrical and all other applicable codes, except as follows: 1. In A through G occupancies as defined by the Uniform Building Code: a. All electrical wiring shall be installed in rigid metal conduit, electrical metallic tubing, underfloor raceways of approved insulating material, cellular metal floor raceways, surface metal raceways, wireways, busways, and auxilIary gutters. b. Flexible metal conduit may be used where it is impractical to use any of the above methods, subject to the approval of the Building Official. c. A bond wire not less than #12 AWG must be installed in flexible metal conduit. 2. In H occupancies as defined in the Uniform Building Code: In any building with five (5) or more dwelling units, flexible conduit may be used in place of rigid conduit subject to the approval of the Building Official. Four (4) units or less may be wired with any approved method which provides continuous grounding. Any H or I occupancies that occupy a floor above an A through G occupancy shall be wired as the occupancy below. D. National Electrical Code (1975 Edition) as approved by the USA Standards Institute is hereby adopted by reference as the National Electrical Code referred to in Sub-sections B & C above. E. All electrical materials, devices, appliances, apparatus and equip- ment installed or used, shall be in conformity with the provisions of this Code and with approved standards for safety to life and property. Listing or labeling, as conforming to the Standards of the Underwriters' Laboratories, Inc., the National Bureau of Standards, the United States Bureau of Mines, or other nationally recognized laboratories, shall be prima facie evidence of conformity with the approved standards for safety to life and property. F. Previously used material shall not be re-used in any work without the written approval obtained in advance from the Chief Electrical Inspector. Section 8-3.08 ALTERATIONS ANQ ADDITIONS Additions or extensions to, and alterati~ns and renewals of existing installations shall be made in compliance with the provisions of this Code. ORD. 118 C.S. - 5 - ---,- ----~ ---~- ~ '" 4 . , ,~ ~ Section 8~3.09 RESPONSIBILITY This Code shall not be construed to relieve from or lessen the responsibil- ity of any party owning, operating, controlling or installing any electrical wiring, devices, appliances, apparatus, or equipment for damages to person or property caused by defects therein, nor shall the local agency enforcing this Code be held as assuming any such liability by reason of the inspection authorized herein, or certificate of inspection and approval issued as herein provided. Section 8~3.10 INTERPRETATION The language used in this Code and in the National Electrical Code, which is made a part of this Code by reference, is intended to convey the common and accepted meaning familiar to the Electrical Industry. The Chief Electrical Inspector is hereby authorized to determine the intent and meaning of any provision of this Code. Such determination shall be made in writing and a record kept, which shall be open to the public. Section 8-3.11 VIOLATIONS Every person, firm or corporation violating any of the provisions of this Code shall be deemed guilty of a separate offense for each day or portion thereof during which such violation continued and shall be punishable therefor as herein provided. Section 8-3.12 PROHIBITIONS It is unlawful for any person, firm or corporation, either as owner, architect, contractor, artisan or otherwise, to do or knowingly to cause or permit to be done any electrical wiring as defined in this Code in such manner that the same shall not conform to all of the provisions of this Code. Section 8-3.13 REPEAL OF CONFLICTING ORDINANCES All ordinances or parts of ordinances which are in conflict with the provisions of this ordinance are hereby repealed. Section 8-3.14 VALIDITY If any section, sub-section, sentence, cl'iluse, or phrase of this ordinance is, for any reason, held to be unconstitutional or legally ineffective, such decision shall not affect the validity of the remaining portions of this ordinance. The legislative body of the City, County or Public District which has enacted it declares that it would have adopted this ordinance and each section, sub-section, sentence, clause or phrase thereof, irrespective of the fact that anyone or more sections, sub-sections, sentences, clauses or phrases be declared unconstitutional or legally ineffective. SECTION 2: This Ordinance shall be in full force and effect thirty (30) days after its passage, and within fifteen (15) days after its passage, it shall be published once, together with the names of the Councilmen voting thereon, in the Five Cities Times-Press-Recorder.
