O 114 C.S. . . I- e) ORDINANCE NO. 114 C.S. AN ORDINANCE OF THE CITY OF ARROYO GRANDE AMENDING CHAPTER 1, TITLE 8 OF THE ARROYO GRANDE MUNICIPAL CODE TO PROVIDE FOR ADOPTION OF THE 1973 EDITION OF THE UNIFORM BUILDING CODE AS MODIFIED HEREIN. THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE DOES ORDAIN AS FOLLOWS: SECTION 1: Cp~pter 1 of Title 8 of the Arroyo Grande Municipal Code is amended to read as follows: Section 8-1.01 ADOPTION OF UNIFORM BUILDING CODE For the purposes of regulating the erection, construction, enlargement, alteration, repair, moving, removal, conversion, demolition, occupancy, equip- ment, use, height, area, and maintenance of buildings and structures in the City, the issuance of permits, and the collection in the City, the issuance of permits, and the collection of fees therefor, and declaring and establishing fire districts, that certain Code designated as the "Uniform Building Code", 1973 Edition, published by the International Conference of Building Officials, three (3) copies of which have been filed for use and examination by the public in the office of the City Clerk, is hereby adopted by reference and made a part of this chapter as though set forth in this chapter in full, subject, however, to the amendments, additions, and deletions set forth in this chapter, and said Code shall be known as the Building Code for the City. Section 8-1.02 BUILDING INSPECTOR: OFFICE CREATED: POWERS AND DUTIES. The office of Building Inspector is hereby created, and the Building Inspector is hereby authorized and directed to administer and enforce all the provisions of this chapter and of the Building Code adopted by this chapter, and, for such purpose, he shall have the powers of a police officer. Section 8-1.03 BUILDING INSPECTOR: APPOINTMENT: SALARY: CONSOLIDATION OF OFFICES. (a) Appointment. The Building Inspector shall be appointed by the Council and shall hold office at the pleasure of the Council. (b) Salary. The Building Inspector shall receive such salary as may be determined by resolution of the Council. (c) Consolidation of Offices. The Council may at any time consolidate and place in charge of any other official of the City the functions and duties of the Building Inspector. Section 8-1.04 BUILDING OFFICIAL. "Building Official", as used in this title, shall mean the Planning Director. Section 8-1.05 AMENDMENT OF SECTION 202 (e) - STOP ORDERS Section 202(e) of said Uniform Building Code is hereby amended to read as follows: (e) Stop Orders: Whenever any work is being done contrary to the provisions of this code, or in violation of any other code or City Ordinance, the Building Official may order the work stopped by notice in writing served on any persons engaged in the doing or causing such work to be done, and any such persons shall forthwith stop such work until authorized by the Building Official to proceed with the work. If unable to serve such person with a notice, the Building Official shall post the stop order in a prominent place on the site. Such posted notice shall only be removed by the Building Official. Any person proceeding with unauthorized work after being served or having a notice posted on his job site, shall be deemed guilty of a separate offense for each and every day or portion thereof during which such work is being performed. (~ Q Section 8-l.0b-AMENDMENT OF SECTION 301 (b)'~ PLICATION Section 30l(b) of said Uniform Building Code is hereby amended by adding Subsection 8 thereto to read as follows: 8. All contractors must have applied for and obtained a City Business License before a permit can be issued. Section 8-1.07 AMENDMENT OF SECTION 2623 - ~NIMlJM SLAB THICKNESS Section 2623 of said Uniform Building Code is 'hereby amended to read as follows: Section 2623 (a) The minimum thickness of concrete floor slabs supported directly on the ground shall be not less than three and one~half inches (3~"). Section 2623 (b) Where concrete slab floor on grade construction is used and slabs are not poured monolithic with footings, there shall be placed vertically in all perimeter footings three-eighths 'inc.h (3/8") deformed steel reinforcing bars, spaced two feet (2') center to center. These bars shall be bent inward and tied by the 6 x 6 - 10 x 10 wire mesh slab reinforcing prior to pouring the slab. Vapor barriers shall not extend overbearing surfaces of the perimeter footings or stem walls. When floor slabs and footings are poured monolithic, the three-",ighths inch (3/8") diameter vertical reinforcing may be omitted. All building slabs shall have a minimum 6 x 6 - 10 x 10 wire mesh reinforcing and vapor barrier. Section 8-1.08 AMENDMENT OF SECTION 2907 , Subsection (b) of Section 2907 of said Uniform Building Code is amended by adding the following paragraph thereto: Unless otherwise required elsewhere in this Code, not less than one continuous deformed steel reinforcing bar of at least one-half inch (~") in diameter shall be placed in all footings. Where foundation walls are used, at least one additional bar shall be placed not less than three inches (3") nor more than six inches (6") from the top of such walls. Bars shall be held in place by chairs and/or tying. Section 8-1.09 AMENDMENT TO SECTION 7002 Section 7002 of said Uniform Building Code is hereby amended to read as follows : Section 7002: This chapter sets forth rules and regulations to control excavation, grading and earth-work construction including fills and embankments, establishes the administrative procedure for issuance of permits and provides for approval of plans and inspection of grading construction. The Director of Public Works is hereby authorized and directed to enforce all the provisions of this chapter. 1. When the term or title "Building Official" is used within this chapter it shall mean the Direc~or of Public Works. 2. When the term "Building Department" is used within this chapter it shall mean the Department of Public Works. ,Section 8-1.10 AMENDMENT OF SECTION 7009. Section 7009 of said Uniform Building Code is hereby amended by adding Subsection (d) thereto as follows: Section 7009 (d) Retainin~ Walls. Retaining Walls located on the property line shall be only constructed of concrete or masonry materials with the design conforming to the specifications of the City. (~ S ction 8-1 l"-,AMENDMENT TO SECTION 303 a Section 303(a) of said Uniform Building Code is hereby amended by amending Table No. 3A therein to provide as follows: TOTAL VALUATION FEE $1.00 to $500.00 $5.00 $501.00 to $2,000.00 $5.00 for the first $500.00 plus $1.00 for each additional $100.00 or 'fraction thereof, to and including $2,000.00 $2,001.00 to $25,000.00 $20.00 for the first $2,000.00 plus $3.00 for each additional thousand or fraction thereof, to and including $25,000.00 $25,001.00 to $50,000.00 $89.00 for the first $25,000.00 plus $2.50 for each additional thousand or fraction thereof, to and including $50,000.00 $50,001.00 to $100,000.00 $151.50 for the first $50,000.00 plus $1.50 for each additional thousand or fraction thereof, to and including $100,000.00 $100,001.00 and up $226.50 for the first $100,000.00 plus $1.00 for each additional thousand or fraction thereof Section 8-1.12 AMENDMENT TO SECTION 303 (b) - PLAN CHECKING FEES. Section 303(b) of said Uniform Building Code is hereby amended to read as follows: (b) Plan Checking Fees: When the valuation of the proposed construction exceeds $1,000.00 and a plan is required to be submitted by Subsection (c) of Section 301, a plan-checking fee shall be paid to the Building Official at the time of submitting plans and specifications for checking. Said plan-checking fees shall be one-half of the building permit fees as set forth in Table No. 3A. Where plans are incomplete, or changed so as to require additional plan checking, an additional plan-check fee shall be charged ata rate established by the Building Official. ,Section 8-1.13 AMENDMENT TO SECTION 7007 - PLAN-CHECKING AND GRADING PERMIT FEES.
