RESOLUTION NO. 646
RESOLUTION OF CITY COUNCIL OF CITY OF ARROYO GRANDE
CONFIRMING THE REPORT OF THESJPERINTENDENT OF STREETS
AND LEVYING ASSESSMENT FOR THE INSTALLATION OF CURB,
GUTTER AND DRIVEWAY APRONS.
WHEREAS, pursuant to the provisions o:f the "Improvement Act o:f
1911", being Division 7 o:f the Streets and Highways Code o:f the
State o:f Ca1i:fornia, the Superintendent o:f Streets did on the
5th day o:f February, 1965, noti:fy the owners or persons in
possession o:f those certain properties within the City o:f Arroyo
Grande, Ca1i:fornia, located at: Lots 1 to 11 inclusive, Block 3
and Lots '12 to 22 inclusive, Block 2, Tract No. 80, to cause certain
installation o:f curb, gutter and driveway aprons to be made
adjacent to the hereinabove properties; that the owners or persons
in possession, so noti:fied, :failed and neglected to cause said
installation to be made; and that the Superintendent o:f Streets
proceeded to have said installation done and made at a total cost
o:f Four Thousand Two Hundred Sixty-two Dollars and seventy :five
cents ($4,262.75); and
WHEREAS, the said Superintendent o:f Streets, upon the completion
o:f said installation, :filed with this City Council his report
upon said installation and costs thereo:f, and gave notice to the
owners or persons in possession o:f said properties hereinabove
re:ferred to, in the time, :form and manner prescribed by law, that
the hour o:f 8:00 P.M. on the 23rd day o:f February, 1965, was the
hour :fixed :for hearing upon said report; and evidence having been
received thereon,
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF ARROYO GRANDE, as :follows:
Section 1. That all notices have been given as provided by
law and required by the Provisions o:f the "Improvement Act o:f
1911" and that the report o:f the Superintendent o:f Streets upon the
installation be, and it is hereby confirmed.
Section 2. Tnat an assessment in the amount o:f $4,262.75
representing the installation made by the Superintendent o:f Streets
against the properties hereinabove described is hereby made and
con:firmed; and the Superintendent o:f Streets is hereby directed
to noti:fy such owners or persons in possession o:f said properties
o:f said assessment.
Section 3. That i:f the owners or persons in possession o:f
said properties :fail to pay said assessment within :five (5)
days :from date hereo:f, as provided by law, the Superintendent o:f
Streets shall record a Notice o:f Lien in the O:f:fice o:f the County
Recorder o:f the County o:f San Luis Obispo.
On motion o:f Councilman Wood , seconded by
Councilman McNeil , and on the :following roll
call vote, to-wit:
AYES: Councilwoman Thompson, Councilmen McNeil, Burt, Wood and
Mayor Jacobs.
NOES: None
ABSENT: None
