RESOLUTION NO. 609 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE, ESTABLISHING PROCEDURE PRIOR TO THE INSTALIATION OF CURB, GUTTER AND SIDE- WALKS ADJACENT TO IMPROVED PROPERTY. WHEREAS, under the provisions of Ordinance No. 105 of the City of Arroyo Grande, it was provided that the City Council of the City of Arroyo Grande was authorized to adopt Rules and Regulations per- taining to the construction of buildings and structures in the City of Arroyo Grande by Resolution, and WHEREAS, it is necessary to adopt Rules and Regulations pertain- ing to the issuance of permits for the installation of curb, gutter and sidewalks adjacent to improved property, and WHEREAS, it is beneficial to the City and to the property owners to install curb, gutters and sidewalks on existing streets for the control of drainage and to provide for pedestrian traffic out of the path of moving vehicles using the roadway, now THEREFORE, be it resolved by the City Council of the City of i Arroyo Grande as follows: 1. Applications for grades of curbs will be made to the Department of Public Works with a brief description of the property and location of the proposed improvements. 2. The Director of Public Works and/or the City Engineer shall review the site of the work and determine if there is any obvious reason why grades would be "incompatable" in this location. 3. Upon determining that curbs can be installed without creating a drainage problem (in their best judgement) the Director of Public Works shall notify the City Council of the request for grades and ask for authori- zation to establish official street grades for the work. 4. Upon being authorized by action of the City Council, the Director of Public Works shall notify the City Er.ginee:c to make the necessary survey and prepare plans establish- ing official street grades for the work. In order that continuity of drainage may be assured, the survey, plans and designs shall extend to a point of concentration of storm runoff where it can be disposed of in an existing channel or drainage facility, or to a point mutually agreed upon by the Director of Public Works and the City Engineer where it will not create a public hazard. 5. Completed plans shall be submitted to the Director of Public Works for his approval prior to setting grades for construction of the improvements. After the plans have been approved by the Director of Public Works, the City Engineer shall have the grades marked for construction on the site of the work and review them on the site with the Director of Public Works. - 6. Following approval of the staking for the work, the Director of Public Works shall notify the owner that grades have been set and staked and authorize construc- tion to be started. 7. The City must expend considerable effort and monies to establish official street grades; therefore it will be necessary for the owner to post a surety or cash bond with the City Clerk in the amount of 100% of the project to assure that the work will be done after grades have been established. 8. It is the intent of the City Council to promote orderly growth of improvements within the City with a minimum of cost to the City and to the property owners, therefore official street grades will be established to cause as little interference as possible with existing facilities, consistent with sound principles of engineering practice. Costs of construction of the curb, gutter and sidewalk facilities and driveway modifications necessary to connect with the new work shall be paid for by the property owner. Grading, base material and surfacing required within the street area shall be installed to the lip of the newly constructed gutter by the City.
