RESOLUTION NO. .8~S-
IN THE MATTER OF THE CONDEMNATION OF THE ABEL PROPERTY
BE IT RESOLVED, that the City Council of the City of Arroyo
Grande, a Municipal Corporation, of the State of California,
located in the County of San Luis Obispo, state of California,
has found and determined and does hereby find and determine that
the public interest and necessity require the acquisition, con-
struction, completion and maintenance by the said City of Arroyo
Grande, a Municipal Corporation, of a public improvement, to-wit:
An easement and rights of way for the purpose of installing,
maintaining, repairing, replacing and/or removing sewage lines.
And that the properties hereinafter described are necessary there-
for.
BE IT FURTHER RESOLVED, that Richard F. Harris, as attorney
for said City of Arroyo Grande, a Munioipal Corporation, be, and
he is hereby authorized and directed to file such condemnation
suit or suits as may be necessary to acquire the properties here-
inafter described and to prosecute the same in any and all proper
courts in the name of the City of Arroyo Grande, a Municipal Cor-
poration, as Plaintiff, against any and all proper persons as de-
fendants necessary to acquire title for easements or rights of
way as may be more particularly set forth in the description of
the properties hereinafter contained, 'said titles to said property
to be in favor of the Ci ty of Arroyo Grande ,a Munioipal Corpora-
tion, for the purposes above set forth.
The premises referred to heretofore and sought to be condemned
are described as follows, to-wit:
Parcell. An easement and right-of-way for the purpose of install-
ing, maintaining, repairing, replacing and/or removing

sewer lines in, under, along and through all that cer-
~ tain strip of land in the City of Arroyo Grande, County
of San Luis Obispo, State of California, being more
particularly desoribed as follows, to-wit:
Commencing at the intersection of the oenter line
of South Alpine Street with the center line of NeWMan
Drive; thence running North 890 47' East, 575.40 feet
along said center line of said Newman Drive to the
Easterly terminus thereor; thence South 00 13' East,
25.00 feet; thenoe South 10 09' East, 97.63 reet;
thence South 660 26' 20. East, 153.77 feet to the
Northerly line of property conveyed to Ross Abel;
thence South 890 47' West along said line 7.40 feet
to the true point of beg+nning; thenoe running from
said true paint of beginning the following oOUrses
and distances:
(1) South 20 33' East, 184.15 feet to the Southerly
line of t he property oGlnveyed to Ross Abel.
(2) South 890 47' West, 10.01 feet along said line.
(3) North 20 33' West, 180.83 feet.
(4) North 660 26' 20" West, 8.23 feet to the North-
erly line or property so conveyed.
(5) North 890 47' East, 17.40 feet along said line
to the true point of beginning.
Parcel 2. together with two (2) temporary easements for the
purposes of construction and installation of sewer
linea and appurtenances in Parcel 1 above-described,
together with access in, over and, along said tempor-
aryeasements\during a period not to exoeed one year
from the ~ day of February, 1958, which said
temporary easements shall be over two separate pieces
or property each 20 reet in width; the first of said
temporary easements being over property parallel to,
~jaoent and Westerly ef the Westerly boundary of _ ..I
Paroel 1 above described, and the other temporary
easement being over property parallel to, adjacent
and Easterly of the Easterly boundary of Parcel 1
above described.
