Minutes 1991-09-10 435 I I MINUTES I REGULAR MEETING OF THE CITY COUNCIL I TUESDAY, SEPTEMBER 10, 1991 CITY coUNCIL CHAMBERS, 215 EAST BRANCH STREET ARROYO GRANDE, CALIFORNIA The city council of the city of Arroyo Grande met at 7:30 P.M. 'with Mayor Mark M. Millis presiding. 1. & 2. FLAG SALUTE AND INVOCATION Mayor Millis led the Pledge of Allegiance to our Flag, and the Rev. James Wickstrom of Berean Bible church delivered the invocation. "1 3. ROLL CALL Present were, Mayor Millis and council Members A. K. "Pete" Dougall, Gene Moots and B' Ann smith. council Member Olsen was absent. Staft Members present were city Manager chris Christiansen, city Attorney Judy Skousen, city clerk Nancy Davis, Acting public Works Director Dave MUlkey, Deputy public Works Director Avelino Lampitoc and chief of Police Rick TerBorch. 4. oRAL coMMUNICATIONS LORI ZAHN of 2750 Branch Mill Road urged council Members to attend the pUblic hearing on expanded offshore drilling off the San Luis Obist>o, 'Saitta Barbara and Ventura Coasts. She said the single public hearing, sponsored by the united States Department of the Interior, will be held on september 18, 1991 at the Saitta Maria Hil ton Hotel. 5. Mayor Millis presented the proclamation to Patti Whita of the Arroyo Grancte police Department. . 6. REGISTER OF CHECKS It was moVed by Dougall/Smith, and the motion passed to " approve cash Disbutsaments in the amount of $501,030.93, as listed in the September 10, 1991 Statf Report of Finance Director David Bacon. 7.A. HOOK RAMPS AT CAMINO MERCADO No Report. 7.B. UPDATE ON COUNTY PROJECTS AFFECTING THE CITY No Report. 8.A. REOUEST OF LUCIA MAR UNIFIED SCHOOL DISTRICT FOR A ONE-YEAR EXTENSION OF THE LEASE AGREEMENT FOR LOPEZ HIGH SCHOOL Mayor Millis said he may have a conflict of interest in this matter and left the toom. Mr. christiansen referred to the september 3, 1991 letter from the school district requestinq a one-year extension of the lease agreement for Lopez High School at the Elm Street site. He " recommended that the council approve the district's request with two conditions, ('1) that the contract be extended to July 1, 1992 in order to allow time for furnishings to be removed from the buildinq, and (2) that the School District "sell II the existing I buildings to the city effective JUly 1 , 1992 for approximately $1. 00. It was moved by Smith/Dougall, and the motion passed to approve Mr. christiansen's recommendation. Mayor Millis returned to the dais. 8.C. REOUEST OF ARRoyo GRANDE COMMUNITY HOSPITAL FOR A ONE-YEAR EXTENSION TO AOGUST 31. 1992. FOR coMPLETION OF IMPROVEMENTS ON PAltcEL MAP No. AG89-423 (BIKE AND WALKING PATH ALONG THE CREEK AND THE NORTHERN BOUNDARY OF THE PROPERTY TO WOObLAND DRIVE} Mr. christiansen referred to the July 24, 1991 letter from Arroyo Grande community Hospital chief Executive Officer Richard woolslayer requesting an extension of time on completion of improvements connected with parcel Map AG89-423. Mr. christiansen recommended that the one year extension be granted to August 31, 1992 for the completion of improvements, with the condition that the hospital immediately clean the bike and walking path along the creek so that it can be used by citizens who wish to do so. BOB BROWN of 617 Cerro vista circle said he did not mitld the postponement, but said the weeds need to be cleaned out and the equipment cleaned up and repaired at the health park. . It was moved by Moots/Dougall,' and the motion passed to approve Mr. christiansen's recommendation. 9. WRITTEN coMMUNICATIONS Mr. christiansen read a letter of resignation from BillY Howells, parks and Recreation commission member. Mayor Millis and the council Members accepted the resignation with regrets. Mayor Millis said Mr. Howel1s had served the commission for 11 years and would be missed. . . 10. oRAL COMMUNICATIONS LEoNARD LENGER of 1203 carpenter Canyon Road objected to the fact that he had been named a~ a cross complainant in a lawsuit against the city. He said he had obtained le~al counsel and will be asking the city to pay his legal fees. He said the ori~inal " lawsuit concernin~ a lot split otl Tally Ho Road and Ridgeview Way is frivoloUs. Both Mr. Lenger and ED cHADWELL of 290 Ridqeview Way, also a cross complainant, said that the name of SALLY WHITE ShbUld be removed from the list of cross complainants by the city. They said she is ill and an innocent party. 11.
