MEETING OF THE CITY COUNCIL
TUESDAY, FEBRUARY 27, 1990
CITY COUNCIL CHAMBERS, 215 EAST BRANCH STREET

The City Council met in a closed session from 7:00 to 7:30
P.M. to discuss Potential Litigation: Government Code Section
54956. 9(b)( 1).
The Council convened for the regular session at 7:30 P.M.,
with Mayor Mark M. Millis presiding.

ROLL CALL
Present were Mayor Millis and Council Members A. K. "Pete"
Dougall, Gene Moots, Doris Olsen and B'Ann Smith.
5. PRESENTATION OF Rf:SOLUTION RECOGNIZING DETECTIVE JOHN TOOLEY AS
THE 1990 OFFICER OF THE YEAR.
Mayor Millis read the resolution honoring DETECTIVE JOHN
TOOLEY for his outstanding service to the community, his exemplary
professionalism, and his service and accomplishments.
It was moved by smi thjMoots (5-0-0, Smith, Moots, Dougall,
Olsen and Millis voting aye) to approve Resolution No. 2374
Recognizing Detective John Tooley as the 1990 Officer of the Year.
6. PRESENTATION OF PLAOUE OF APPRECIATION TO FORMER PARKING AND
TRAFFIC COMMISSIONER SPENCE THOMAS
Mayor Millis presented a plaque to SPENCE THOMAS, former
member of the Parking and Traffic Commission, and thanked him for
his more than four years of service to the Commission.

8. CONSENT AGENDA
It was moved by SmithjMoots, and the motion passed, to approve
Consent Agenda Items 8.B. throuqh 8.J. , with the recommended
courses of action.
8.B. Liability Claim, Jeffrey A. carrithers. Rejection Approved.
8.C. Purchase of Fire Fighter self-contained Breathing Apparatus,
Fire Department, Budgeted Item. Approved.

8.J. Funding for Planning Commission Institute. Approved.
Mayor Millis read a proclamation for "Arbor Day," March 7,
1990, as part of Consent Agenda Item 8.A. Receiving the
proclamation was John Keisler, Director of Parks and Recreation.
Mr. Keisler extended an invitation to a City tree planting ceremony
March 10, 1990, at the Community Center, and told about an Arbor
Day Poem and Art Contest for children up to 18 years of age.
Council Members decided to contribute to the planting of a
tree for Arbor Day.

It was moved by Smith/Moots, and the motion passed, to approve
the Cash Disbursements, as contained in the February 22, 1990,
Staff Report of Finance Director David Bacon.

After being assured that the Public Hearing 'had been duly
pUblished and all legal requirements met, Mayor Millis declared the
hearing open and said all persons would be heard regarding the
matter.
JIM MC GILLIS, surveyor with San Luis Engineering, spoke in
favor of the project and said he would answer Council questions.
There being no further public discussion on the matter, Mayor
Millis closed the hearing to the floor.
Council Members discussed the project and gave it their
approval on the basis of (1) the commitment at the time the land
was annexed to the City to develop the property, (2) the water-
saving plan proposed by the proponents, (3) the planned completion
of Oak Park Road, (4) the well-site on the property, and (5) the
park land which is to be given to the City as part of the project.
Mayor Millis said the proponents of the development will
return to the City Council for approval of the tract map, and at
that time mitigating measures will be discussed.
A Motion of Intent to Approve PD Rezone Case No. 89-217:
Development Plan; and Tentative Tract Map 1769 was made by
smith/Olsen, and the motion passed.
smi th/Olsen also made a Motion of Intent, and the motion
passed, to Adopt a Mitigated Negative Declaration, with an added .-.,
mitigation measure as follows:
"The applicant shall formulate a water
conservation program to be approved by the
city Council prior to recordation of the tract
map. The program shall include a provision which,
when implemented, will reduce domestic water
demand by 300 percent of the estimated water demand
for Tract No. 1769. The estimated demand for
Tract 1769 (for purposes of calculation)
shall be .5 acre feet per dwelling unit per
year. This consumption is based upon lot
size, location and projected land use for this
subdivision. The reduction can be gained from
conservation programs to be included both on-
and off-site within the city of Arroyo Grande
water service area."

It was moved by Smith/Dougall, and the motion passed, to
instruct Staff to return to the March 27, 1990, meeting with
Conditions of Approval and Findings for Approval, and publish a
Negative Declaration.
11.A. UPDATE ON BRIDGE STREET BRIDGE AT ARROYO GRANDE CREEK
Public Works Director Paul Karp reported that the first of the
trusses for the rehabilitated bridge should be in by the next
Council meeting. He said the pr~ject is on schedule.

Olsen and Millis voting aye) to approve Resolution No. 2375
Requesting Technical Assistance from the State Coastal Conservancy. I
12 . C. PARKING SITUATION AROUND STREETS AND HOMES NEAR ARROYO GRANDE
HIGH SCHOOL
Mayor Millis said he may have a conflict of interest on this
matter and left the dais.
Mr. Christiansen said that the Lucia Mar Unified School
District Board had taken the following actions:
(1) Commencing March 1, 1990, student parking will be opened I
up and on a first come, first serve basis, which should take
between 50 and 75 additional cars off the streets. I

~ (2) Approximately 30 spaces will be added for School District
personnel near Building 900 on the High School campus.
(3) The District hopes to have an additional 100 to 150
parking spaces constructed in the "agriculture" area of the school
by September, 1990.
HERMAN OLAVE, 222 West Ch,erry Avenue, said the neighbors would
go along to see how the School District's plans work out. He
objected to the time of the Parking and Traffic Commission meeting I
being changed, and not being allowed to speak more than three
minutes at the commission meeting. He praised the Police I
Department for the good job patrolling the neighborhood. I

GARY MORAN of 426 California Avenue suggested some measures,
including a signal at Valley Road and Fair Oaks Avenue, to control
the traffic around the school.
After Council discussion, staff was directed to follow up and
verify the School District's plan to improve the parking problem.
Mr. Christiansen said he would discuss with the Police Chief the
suggestions made for improving the traffic around the school.

13.A. PROPOSED PARKING LOT BEHIND THE COUNCIL CH~MBERS ~
Mr. Christiansen said the Downtown Parking Advisory Board has
recommended that the low bidder Robert S. Vessely be retained to
design the parking lot behind the city Council Chambers for
$ll,250. Mr. Christiansen said the project includes an easement
off Branch street for access to the' parking lot. He said the
Downtown Parking Advisory Board also recommended that City monies,
rather than Parking and Improvement monies, be used on the city-
owned parcel in the event that in the future the city decides to
sell its parcel. He said if this recommendation were followed,
there would be no complicating ties with the downtown merchants.
After Council discussion, it was moved by Smith/Dougall, and
the motion passed, to award the contract for design of the Parking
Lot Behind the City Council Chambers to Robert S. Vessely in the
amount of $11,250, and to follow the recommendations of the
Downtown parking Advisory Board.

Mr. Christiansen recommended that the Council deny the request
on the basis that the funds will be needed by the City.
It was moved by OlsenjMoots, and the motion passed, to deny
the request of Santa Clara County Traffic Authority.

15.A. KARL KEMPTON of Oceano commented on the dangers of
pesticides in farming, and said some State and County agriculture
officials are not working to solve the problem. He discussed the
necessity of using non-chemical techniques in farming for the long
term. with regard to the proposed subdivision at Farroll Avenue
at the Western city limits, council Member smith asked about the
depth of the soil tests for harmful chemicals. Planning Director
Doreen Liberto-Blanck said the test was prepared last August, and
were taken at a depth of lS inches. .-,
15.B. Council Member Smith requested that Staff look into the
night lighting at the Lucky/Payless Shopping Center. She said the
lighting was poor and there could be a safety hazard.
15.C. Council Member Dougall requested Staff to investigate
the excessive number of vehicles parked in the front yard of a home
on Grand Avenue next to McDonalds.
15.D. Mayor Millis announced that it is his intention to
nominate at the next City Council meeting James M. Souza of 1095
Robin Circle to the Parking and Traffic Commission.
IS.E. Mayor Millis said that during the Closed Session held
at the beginning of the meeting, Council Members had taken action
to hire Scott S. Slater from the law firm of Hatch and Parent of

Santa Barbara to render additional legal assistance to the city.
15.F. ANNE STEELE of 1432 Mentone, Grover City, spoke with
regard to the proposed subdivision at Farroll and the Western City
limits, and said that soil testing for pesticides should be done
at the depth of construction, three or more feet. She said the
problem of airborne particulate should be addressed. She quoted
from Report No. 474-5, "Regulation vs. Practice," published by the
State Senate Office of Research.
15.G. The Council set a Special Adjourned meeting on Water for
7:00 P.M. Monday, March 5, 1990.
