RESOLUTION NO. 3261
A RESOLUTION OF THE CITY COUNCil OF THE CITY .
OF ARROYO GRANDE SUMMARilY VACATING A
PORTION OF HUBER STREET
WHEREAS, it is in the public interest that the portion of Huber Street more specifically
described below be summarily vacated, and
WHEREAS,the Planning Commission reviewed the tentative map showing the elimination
of the portion of Huber Street described below and determined that said vacation,
concurrent with the dedication shown on lot Line Adjustment Case No. 96-531, is in
conformity with the General Plan.
NOW, THEREFORE, BE IT RESOLVED AND ORDERED that the City Council of the City
of Arroyo Grande finds, declares, and determines as follows:
1. That the recitals set forth above are true and correct.
2. That this vacation made pursuant to Streets and Highways Code, Sections
8330 et seq.
3. That this based on a review of all of the evidence submitted, the portion of
Huber Street, described in Exhibit A and shown on Exhibit B (map), each
attached hereto and made a part hereof, is unnecessary for present or
prospective public use.
4. That it hereby is ordered that said portion of Huber Street, above described,
is summarily vacated as a City street of the City of Arroyo Grande, State of .
California.
5. That in support ofthis decision to vacate said street, this Council makes the
following findings and has determined that the following conditions exist:
a. For a period of five consecutive years, the street has been impassible
for vehicle travel.
b. No public money was expended for maintenance of the street within
that time period.
c. Vacation of the portion of the subject street will not impair public or
private access.
d. Vacation of the portion of the subject street will not affect existing
traffic circulation.
e. This street vacation is in the public interest, in that the City will receive
concurrent offers of dedication along preferable alignments.

. 6. That the City Clerk of the City of Arroyo Grande is hereby ordered and
directed to record concurrently with the recordation of certificates of
compliance finalizing Lot Line Adjustment Case No. 96-531 , a certified copy
of this Resolution, attested by the Clerk under seal, in the Office of the
Recorder of San Luis Obispo County, State of California.
7. That upon such recordation, the vacation is complete.

, and on the following roll call vote, to wit:
AYES: Council Members Runels, Lady, Tolley, and Mayor Dougall
NOES: None
ABSENT: Council Member Fuller
