AN ORDINANCE OF IRE CITY OF ARROYO GRANDE REPEALING
ARROYO GRANDE ORDINANCE NO. 77 C.S. RELATING TO THE
REZONING OF CERTAIN PROPERTY FROM RA-B3 RESIDENTIAL
AGRICULTURAL DISTRICT TO R.G. -D GARDEN APARTMENT
RESIDENTIAL DISTRICT WITH A "D" OVERRIDE.
WHEREAS, the City Council of the City of Arroyo Grande on the 9th day
of January, 1973, adopted an ordinance amending the City of Arroyo Grande
Zoning Ordinance to rezone certain property from RA-B3 Residential Agricultural
District to R.G. -D Garden Apartment Residential DistrJ.ct with a "D" override;
the "D" designation to indicate maximum density not to exceed seven (7) dwelling
units per gross acre; and
WHEREAS, a referendum petition was circulated within the City of Arroyo
Grande and filed with the City Clerk prior to the effective date of Ordinance
No. 77 C.S.; and
WHEREAS, the Arroyo Grande City Clerk has completed her examination of
the petition and has filed her certificate showing the result of her examina-
tion; and
WHEREAS, the Arroyo Grande City Clerk's certificate states that said
referendum petition is signed by not less than 10% of the voters of the City
of Arroyo Grande according to the County Clerk's last official report of
registration to the Secretary of State; and
WHEREAS, said City Clerk's certificate was presented to the Arroyo
Grande City Council at its meeting of February 27, 1973, and the matter of
reconsidering Arroyo Grande City Ordinance No. 77 C.S. and good cause
appearing therefore;
IT IS ORDAINED by the City Council of the City of Arroyo Grande as
follows:
SECTION 1: Arroyo Grande City Ordinance No. 77 C.S. is hereby repealed.
SECTION 2: This ordinance shall be in full force and effect thirty (30)
days after its passage, and within fifteen (15) days after its passage it shall
be'published once, together with the names of the Councilmen voting thereon, in
the Five Cities Times-Press-Recorder.
On motion of Councilman Talley, seconded by Councilman Millis and on
the following roll call vote, to wit:
AYES: Councilmen Millis, Talley, Wood, de Leon and Mayor Schlegel
NOES: None
ABSENT: None
the foregoing Ordinance was pa.ssed and adopted this 27th day of March, 1973.
