OF ARROYO GRfu'>DE AMENDING THE ARROYO GRA~DE ML~TCIPAL CODE BY ADDING CHAPTER 8 10 TITlE 2 TO PROVIDE FOR A FINANCE DIRECl~R IN THE CITY OF ARROYO GRANDE. The City Council of the Cit"j' of Arre:;"'-, Granqe does ordain as follows: SECTION 1. Title 2 of the Arroyo Grande Municipal Cod". is amended by adding Chapter 8 relating to the appointmor:t of a City FinancE Dir(~ctor to read as follows: SECTION 2-8.01 FINANCE DEPARTMENT CREATED A Finance Department is hereby created and established, and shall be subject to the general administrative direction of the City Administrator. SECTION 2-8.02 FUNCTIONS AND DUTIES The Finance Department shall be responsible, for the entire fina.ncial and accounting operation of the City Government, to include but not necessarily be limited to the receipt, disbursement and deposit in the treasury of all City 1 monies, assist in the preparation of the City budge.t, maintenance of all accounting procedures and records, centralized purchasing for all City depart- ments, and any other duties and responsibilities that may be assigned by the City Administrator, City Councilor State law. SECTION 2-8.03 FINANCE DIRECTOR The position of Finance Direcar is hereby created and established, and the position shall be filled by appointment of and serve at the pleasure of the City Council. The Finance Director shall be fully responsible for all functions and duties of the Finance Department, as established by State law, Ordinance or Resolution. " SECTION 2-8.04 FINANCE DIRECTOR - OTHER DUTIES Pursuant to the provisions of Sections 37209 and 40805.5 of the Government Code of the State of California, all financial and accounting duties imposed upon the City Clerk of Sections 40802 through 40805 and Sections 37201 through 37208 of said Government Code are hereby transferred to the Finance Dir~ctor. SECTION 2-8.05 FINANCE DIRECTOR - BOND REQUIRED Before entering upon the duties of said office, the Finance Director shall execute a bond to the City. Except as may otherwise be provided, the. bond shall conform to the provisions of the GCi'.rernment Code relating to bonds of public officers, and the penal sum of the bond shall be in a reasonable amount recom- mended by the City Attorney and fixed by the City Council by resolution. Any premium for said required bond shall be assumed by the City of Arroyo Grande. SECTION 2-8.06 SEVERABILITY If any paragraph, section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council of the City of Arroyo Grande hereby declares that it would have passed this Ordinance. and each paragraph, section, subsection, sentence, clause and phrase thereof, regardless of the fact that anyone or more other paragraphs, subsections, sentences, clauses or phrases be declared invalid or unconstit!!tional. SECTION 2-8.07 REPEAL OF CONFLICTING ORDINANCES Ordinance" and portions of l'rdinances to the extent that they are in conflict with the provisions of this Ordinance are hereby repealed.
