A RESOLUTION OF THE CITY COUNCIL OF THE CITY
1: OF ARROYO GRANDE SETllNG FORTH THE AMOUNT OF
THE IN-UEU FEE FOR OFF-STREET PARKJNG IN THE
. PARKING AND BUSINESS IMPROVEMENT AREA OF THE VILLAGE
WHEREAS, Ordinance No. 489 c:s.of the City of Arroyo Grande establishes the option
of payment of an in-lieu fee for off-street parking spaces in the Parking and Business
Improvement Area of the Village (hereinafter referred to as the -Village Improvement
Area") and provides for the setting of in-lieu fee amounts by resolution of the City
Council; and
WHEREAS, the City has conducted a study which estimates the cost of off-street
parking improvements in the Village Improvement Area.
NOW, THEREFORE, the City Council of the City of Arroyo Grande finds and resolves
that:
1. Findings:
a. The fees collected pursuant to this resolution shall be used only to pay
for off-street parking in the Village Improvement Area.
b. There is a reasonable relationship between the types of development
which may pay said in-lieu fee and the purpose for which the fees will
be used.
2. Cost Estimates:
If the actual or estimated cost of off-street parking improvements in the Village
Improvement Area should change, the City Manager or his/her designee shall review
the fee to determine whether such fee is still adequate. If the fee is determined to
be inadequate, the City Manager shall recommend to the City Council a revised fee
be adopted by resolution.
3. Amount of Fees:
The amount of the in-lieu fee shall be $3,500 per parking space.
4. Time of Payment:
The in-lieu fee for off-street parking shaH be due and payable prior to finat inspection
and/or issuance of a certificate of occupancy, and shall be collected by the Building
. Official. Notwithstanding the above, the City is authorized to collect the fee at the
. time of building permit issuance if the fee is for off-street parking impmvementsfor

which accounts have been established and funds appropriated, and for which the City
has adopted a proposed construction schedule; or the fee is to reimburse the City for
expenditures previously made.
5. Separate Accounts:
The Finance Director shall deposit fees. collected under this resolution in a separate
account. Within sixty (60) days of the close of each fiscal year, the Finance Director
shall make available to the public an accounting of the fund, and the City Council
shall review that information at its next regular public meeting.
6. Annual Adjustment:
The in-lieu fee shall be adjusted each December 31st according to the corresponding
annual increase or decrease in the Engineering News Record construction cost index
(ENR) .
7. Effective Date:
This resolution shall become effective sixty (60) days from the effective date of
Ordinance No. 489 C _5..
