O 027 C.S. , ~. ORDINANCE NO. 27 C,S. AN ORDINANCE OF THE CITY OF ARROYO GRANDE AMENDING TITLE IV OF THE ARROYO GRANDE MUNICIPAL CODE BY ADDING CHAPTER 7 THERETO SO AS TO PROVIDE FOR THE REGULATION OF PRIVATE PATROL SERVICES. THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE HEREBY ORDAINS AS FOLLOWS: SECTION I: Title IV of the Arroyo Grande Municipal Code is amended by adding Chapter 7 relating to private patrol services to read as follows: CHAPTER 7. PRIVATE PATROL SERVICES Sec. 4-7.01: Definitions: For the purposes of this Chapter, the term "Private Patrol Service" shall be deemed to include any person, firm, associ- ation or corporation who agrees to furnish, or furnishes, a watchman, guard, patrolman, or other person, in uniform or otherwise, to protect persons or property or to prevent the theft, unlawful taking, loss, embezzlement, mis- appro~riation, or concealment of goods, wares, merchandise, money, bonds, stocks, notes, documents, papers, or property of any kind; or performs the services of such watchman, guard, patrolman, or other person, for any of said purposes, for a consideration or otherwise. Sec. 4-7.02: Permit Required: It shall be unlawful for any person to engage in the business of conducting,maintaining or soliciting business for any private patrol service in the City of Arroyo Grande without first obtain- ing a permit to do so from the Chief of Police of the City of Arroyo Grande and obtaining a business license as provided in this Chapter and paying the necessary fees therefor. Sec. 4-7.03: Appl icatlon: Investigation: The application for a busi- ness 1 icense to conduct or maintain any private patrol service shall be sub- mitted to the Chief of Police, who shall make an investigation concerning the character of the applicant. Fo II owi ng such investigation, the Chief of Pol ice shall grant or deny the applicant permission to engage in such business. Such permission shall be granted unless it shall appear from such investigation that the applicant is not a person of good moral character or has not a good character in respect to honesty or integrity, or the Chief of Police shall de- termine that the granting of the application would not be in the best interests of law enforcement in the City. Applicant shall submit such information as the Chief of police. may re- quest, such as name, address, organization of the patrol service, its method of operation, the territory or locations it proposes to serve, and the names, addresses, personal descriptions, photographs and fingerprints of its owners, officers and employees. Sec.4-7.04: Any permit granted by the Chief of Police as provided in Subsection 4-7.03 hereof shall be issued upon the following terms and condit- ions: (a) Every employee engaged by the licensee shall be investi- gated in the same manner as the private patrol service under Subsection 4-7.03 hereof, and must be found to be of the same good moral character as the licen- see. (b) Every person engaged by a patrol service shall at all times wea r an identification card issued by the Chief of Police on the front of the outer garment or uniform in such a way as to be conspicuous and plainly visible. Such card shall name the patrol service by which he is employed, and contain a photograph, personal description, and right index fingerprint of the bearer; provided, however, any identification card issued by a municipality within the County of San Luis Obispo or by the Sheriff of the County of San Luis Obispo, which card contains the same information, may be worn in lieu thereof if such private patrol service has In fact a similar license from that entity. (c) The holder of the identification card shall immediately return the same to the Chief of Police whenever his employment as a private patrolman is terminated. If a private patrolman changes his employment from one pat ro I service to another, he shall report that fact to the Chief of Police and the ~e of his new employer shall be endorsed on his identifica- t ion card. .: - , (d) The Chief of police shall prescribe or approve the style or type of uniform, if any, to be used by said private patrol service, for the purpose of maintaining readily apparent distinction from the uniforms worn by the regularly employed peace officers in the County of San Luis Obispo. Any and all such uniforms shall, however, be slate gray in color. (e) No equipment or motor vehicle shall be used in any business or activity permitted hereunder except with the prior approval of the Chief of Police, who shall inspect such equipment or motor vehicle to insure the main- tenance of a readily apparent distinction from the equipment in motor vehicles used by authorized law enforcement agencies. The Chief of Police shall prescribe or approve the types or character of identification markings or insignia placed on any motor vehicle used in the operation of any private patrol service. All vehicles shall be distinctly marked on the front doors only with the designation "Private Patrol" and all such letters shall be four inches in height. (f) Any such permit, including business license issued pur- suant thereto may at any time be revoked, after notice to the holder thereof and an opportunity to be heard shall have been given pursuant to this Chapter. Sec. 4-7.05: Disputes: Appeals: In all cases if dispute arises con- cerning refusal of granting a business 1 icense under the terms of this Chapter, or concerning the revocation of a business license under the terms of this Chapter, after determination has been made by the Arroyo Grande Chief of Police, any person dissatisfied with such decision may appeal such decision to the City Council within five (5) days after the decision has been made. The City Council shall thereupon hear the matter and make a determination. The decision of the City Council under such circumstances shall be final. SECTION 2: This Ordinance shall be in full force and effect thirty (30) days after its passage, and within fifteen (15) days after its passage it shall be published once, together with the names of the Councilmen voting thereon, in the Arroyo Grande Herald-Recorder. On motion of Councilman Levine, seconded by Councilman Smith, and on the following roll call vote, to wit: AYES: Councilmen Schlegel, Levine, Wood, Smith and Mayor Thompson. NOES: None.
