ORDINANCE OF THE CITY OF ARROYO GRANDE AMENDING SUBSECTION
(c) OF SECTION 1513, CHAPTER 4, TITLE 9 OF THE ARROYO
GRANDE CITY MUN I C I PAL CODE RELAT J NG TO EXCEPTI ONS TO.. THE
\ REQUIREMENTS FOR CURBS AND GUTTERS
The Council of the City of Arroyo Grande ordains as follows:
Sect ion I. Chapter 4, Title 9, of the Arroyo Grande Municipal
Code relating to the exceptions to the requirements for curbs and
gutters is .amended by amending Subsection (c) of Section 1513 to
read as follows:
(c) Curbs and gutters required: Exceptions. Where, in the opin-
ion of the Director of Public Works, such installation of concrete curbs
and gutters is not desirable at the time the building permit is applied
for due to extreme drainage conditions, location, or grading, he may grant.
an exception to the requirements set forth in subsection (b) of this
section.
In the event that an exception is granted under the provisions of
this Section, a deposit shall be required of $2.00 per lineal foot
fronting along city streets and $0.50 per square foot for driveways.
Said deposit shall be held by the Arroyo Grande City Clerk for a period
of ten (10) years to be used for the installation of curbs and gutters,
at such time as Director or Public Works of the City of Arroyo Grande
desires to install said curbs and gutters. In the event that~the CIty
of Arroyo Grande does not Install curbs and gutters along said property
line within ten (10) years of the date said deposit is made, the money.
shall be returned to the owner of record for said property at the end
of said ten (10) year period.
ThIs Ordinance shall be In full force and effect thirty (30) days
after Its passage, and within fIfteen (15) days after Its passage It
shall be published once, together with the names of the Councilmen
voting thereon, In the Arroyo Grande Herald-Recorder.

and Mayor Wood
