ORDINANCE NO. 177
AN ORDINANCE AMENDING SECTION 5.24 OF
ORDINANCE NO. 157, OF THE CITY OF ARROYO
GRANDE ENTITLED "AN ORDINANCE OF THE
CITY OF ARROYO GRANDE, STATE OF CALIFORNIA
ESTABLISHING REGULATIONS PERTAINING TO USES
OF LAND AND USES, LOCATION, HEIGHT, BULK.
SIZE AND TYPES OF BUILDING AND OPEN SPACES
AROUND BUILDINGS IN CERTAIN DISTRICTS OF THE
CITY, SPECIFYING SAiD DISTRICTS, PROVIDING FOR
THE ADMINISTRATION AND ENFORCEMENT OF SUCH
REGULATIONS AND PRESCRIBING PENALTIES FOR
VIOLATIONS THEREOF; REPEALING ORDINANCES IN
CONFLICT HEREWITH" passed and adopted the 9th
day of January, 1962, and repealing all Ord-
inance or portions of Ordinance in conflict
herewith.
The City Council of the City of Arroyo Grande ordains as follows:
Section I. Section 5.24 of Ordinance No. 157, of the City of
Arroyo Grande, entitled "AN ORDINANCE OF THE CITY OF ARROYO GRANDE, STATE
OF CALIFORNIA, ESTABLISHING REGULATIONS PERTAINING TO USES OF LAND AND
USES, LOCATION, HEIGHT, BULK, SIZE AND TYPES OF BUILDING AND OPEN SPACES
AROUND BUILDINGS IN CERTAIN DISTRICTS OF THE CITY, SPECIFYING SAID DISTRICTS,
PROVIDING FOR THE ADMINISTRATION AND ENFORCEMENT OF SUCH REGULATIONS AND
PRESCRIBING PENALTIES FOR VIOLATIONS THEREOF; REPEALING ORDINANCES IN CON-
FLICT HEREWITH" passed and adopted the 9th day of January, 1962, is amended
to read as follows, to-wit:
5.24 Improvements Required
Upon application for a building permit the following require-
ments shall apply to (I) any C, H-S, or M District (2) Any residential
zone where 50% of the frontage in the block on the same side of the street
with curb, gutter and sidewalk.
The improvements are:
THE INSTALLATION OF CONCRETE CURBS, GUTTERS AND SIDEWALKS FOR THE
FULL FRONTAGE OF THE PARCEL UNDER APPLICATION FOR A BUILDING PERMIT TO
THE GRADES AND LOCATIONS APPROVED BY THE DIRECTOR OF PUBLIC WORKS OF THE
CITY OF ARROYO GRANDE.
Except as herein otherwise provided in this section, upon
application for a building permit, the following requirements shall apply:
THE INSTALLATION OF CONCRETE CURBS AND GUTTERS FOR THE FULL
FRONTAGE OF THE PARCEL UNDER APPLICATION FOR A BUILDING PERMIT TO THE
GRADES AND LOCATIONS APPROVED BY THE DIRECTOR OF PUBLIC WORKS OF THE
CITY OF ARROYO GRANDE.
Where, in the opinion of the Director of Public Works, such
installation of concrete curb and gutter is not desirable at this time,
due to extreme drainage conditions, location, or grading, he may grant
exception to this requirement.
In the case of property having frontages exceeding 100 feet the
amount of curb and gutter required will be based on a normal lot frontage,
as determined by the Director of Public Works.
Any person may appeal any determination of the Director of Public
Works regarding the installation of concrete curb and gutter to the
Planning Commission by filing a letter with the Planning Commission out-
lining reasons for the appeal. Within 20 days of receipt of the letter
of appeal, the Planning Commission may affirm, revise or modify the
decision of the Director of Public Works, and such action by the Planning
Commission will be final and conclusive.
Section 2. All Ordinances or portions of Ordinances in conflict
herewith, are herewith repealed to the extent that they are in conflict
with the provisions of this Ordinance.
Section 3. This Ordinance shall take effect and be in full force
and effect thirty (30) days after its passage and within fifteen (IS) days
from its passage it shall be published once in the Herald-Recorder, a'
newspaper printed and published in the City of Arroyo Grande together with
the ~arnes of the Councilmen voting thereon.

on the following roll call vote, to-wi t:

ABSENT: None
the foregoing Ordinance was adopted this 1st day of July, 1963.
