ORDINANCE NO. 161 AN ORDINANCE OF THE CITY OF ARROYO GRANDE PROVIDING MINIMUM REQUIREMENTS FOR THE PROTECTION OF LIFE, LIMB, HEALTH, PROPERTY, SAFETY AND WELFARE OF THE GENERAL PUBLIC AND THE OWNERS AND OCCUPANTS OF RESIDENTIAL BUILDINGS AND ADOPTING THE "UNIFORM HOUSING CODE, 1961 EDITION" and PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE. The City Council of the City of Arroyo Grande does ordain as follows: Section 1. In order to provide minimum requirements for the pro~ tection of life, limb, health, property, safety and the welfare of the general public and the owners and occupants of residential build~ ings, that certain document known and designated as the "UNIFORM HOUSING CODE, 1961 EDITION" is hereby adopted as the "HOUSING CODE" of the City of Arroyo Grande and it shall hereafter apply to all build- ings to be used for human habitation. Section: 2. Three (3) copies of said "UNIFORM HOUSING CODE, 1961 EDIT ION," sha 11 be fi led for use and examination by the public in the office of the City Clerk of the City of Arroyo Grande, and the same shall, at all times, be kept in said office for such use and examination. Section 3. Any person, firm or corporation violating any provision of this Ordinance or of the "UNIFORM HOUSING CODE, 1961, EDITION," shall , be deemed guilty of a misdemeanor and upon conviction thereof shall be , , punishable by a fine of not to exceed Three Hundred ($300.00) Dollars or by imprisonment for a period of not to exceed ninety (90) days, or by both such find and imprisonment, and each separate day or portion there- of during which any violation of this Ordinance or the "UNIFORM HOUSING CODE, 1961 EDITION," above referred to occurs or continues shall be deemed to constitute a separate offense 'and upon conviction shall be punishable as herein provided. Section 4. It is the intention of the City Council of the City of Arroyo Grande to maintain the "UNIFORM HOUSING CODE, 1961 EDITION," and any amendments, revisions or additions thereto in full force and effect at all times recognizing that said "UNIFORM HOUSING CODE, 1961 EDITION" is, fran time to time, amended, revised and added too by its :} ,>"' - ~ - - . .. . . . . ' - publishers, the International Conference of Building Officials, the City Council may, from time to time, by Resolution adopt subsequent amendments, revisions and additions, and in such event three (3) copies of said code as amended, revised or added too shall be kept in the office of the City Clerk of the City of Arroyo Grande for examin- ation and use by the public. Section 5. If any section, subsection, sentence, clause or phrase of this Ordinance is, for any reason, held to be unconstitutional such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed the ordinance and each section, subsection, clause or phrase thereof irrespective of the fact that one or more sections, subsections, clauses and phrases be declared unconstitutional. Section ,6. This Ordinance shall take effect thirty (30) days after its passage, and within fifteen (15) days after its passage it shall be published once together with the names of the members voting for and against it, in the Arroyo Grande Herald-Recorder, a newspaper of general circulation, and within said period of time it shall also be posted in three (3) public places in the City of Arroyo Grande, to-wit: 1 . CITY HALL, 214 East Branch Street, Arroyo Grande, California 2. FIRE HOUBE, 215 East Branch Street, Arroyo Grande, California 3.
